Book Competition Law and Regulation of the EU Electronic Communications Sector

Download or read book Competition Law and Regulation of the EU Electronic Communications Sector written by Liyang Hou and published by Kluwer Law International B.V.. This book was released on 2012-09-01 with total page 398 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book brings satisfying definition and clarity to this field at last. Exploring the substantive differences between competition law and sector-specific regulation after the methodological integration, it presents the first detailed analysis of the many hundreds of notifications and Commission letters generated under the Article 7 procedure, identifying the most relevant cases dealing with market definition, market power, and remedies. It compares these decisions with relevant competition law cases and highlights elements with a bearing on sector-specific regulation. It also offers hugely valuable guidance through the vast amount of documents in the Commission’s CIRCA database. Topics and issues raised include the following: definition of product markets; delineation of geographic markets (including sub-national); different practices in relation to assessing single market power and collective market power; and competition problems such as refusal to deal, margin squeeze, non-price discrimination, and excessive pricing. There can be little doubt that this is the new reference point for researchers and practitioners in this domain. By systematically categorizing the concepts and legal criteria and building a solid theoretical framework on the intersection of competition law and sector-specific regulation, the author has created a resource that is sure to be welcomed by all those involved in regulation of electronic communications markets and network industries in general: academic scholars, telecommunications regulators at the EU and Member State levels, competition authorities, law firms specializing in IT/communications law, practitioners in IT and telecommunications companies, and consultants in the sector. The book will also prove very useful for scholars and practitioners in other parts of the world interested in comparing the EU system with their own.

Download or read book The Right to Roam written by Dualta Roughneen and published by Cambridge Scholars Publishing. This book was released on 2010-01-08 with total page 145 pages. Available in PDF, EPUB and Kindle. Book excerpt: Nomadic groups and sedentary society have been in conflict throughout the ages and the conflict continues to this day. For the most part it is nomadic groups who have been the losers in these conflicts. The idea of human rights has traveled around the world in response to some of the great conflicts of our time. ‘The Right to Roam- Travellers in the Modern Nation State’ examines the right of nomadic groups to maintain a way of life that is contrary to the drive toward sedentarisation and modernisation. If human rights are to exist, one approach to the derivation of rights is that they are to exist as protectors of the autonomy of individuals. When the autonomy of individuals is threatened by restrictions on their liberty then the protection of human rights is required. For Travellers in Ireland, restrictions on the freedom to maintain a Travelling lifestyle have consequences for members of the Travelling community. “The Right to Roam- Travellers in the Nation State’ explores the impact of recent legislation such as the Housing (Miscellaneous Provisions) Act of 2002 on Travellers in modern Ireland and whether progress driven be sedentary society should be required to include the needs of nomadic groups.

Book EC Competition and Telecommunications Law

Download or read book EC Competition and Telecommunications Law written by Andreas Bartosch and published by Kluwer Law International B.V.. This book was released on 2009-01-01 with total page 778 pages. Available in PDF, EPUB and Kindle. Book excerpt: This new volume updates the groundbreaking analysis of its first edition in 2002, when the EC common regulatory framework for electronic communications networks and services had just entered into force. So much has changed in the intervening years that that this new edition bears little resemblance to its predecessor, with every chapter either extensively altered or entirely new. It remains, however, the most detailed and comprehensive overview available of the application of the EC Treaty's competition rules in the markets for telecommunications and audiovisual media, and of the applicable regulatory framework. In thirteen chapters, each contributed by one or more noted legal authorities in the field, the second edition of EC Competition and Telecommunications Law covers the full range of EC telecommunications law across all major areas of both institutional and substantive law, both on the international and EC levels, including the following: State aid; the merger control regulation; justification for sector-specific regulation in EC competition law; network access; authorizations and privileges; and mobile telephony. Relevant EC media and communications law and relevant aspects of EC competition law are dealt with in detail. While some chapters focus on competition law, others deal primarily with sector-specific regulation. There is practical guidance throughout on procedural matters, alongside analysis of the substantive provisions. Well-known in its first edition, this thoroughly revised and updated version continue to be vital reading for practitioners, in particular those specializing in European competition law and for company and in-house lawyers who are seeking advice on how European law affects their business. As a detailed analysis of the basic legislative and regulatory framework of European telecommunications law, it will be an invaluable reference work for lawyers, judges, regulators, and policymakers in all the EC Member States, as well as for students and teachers of European law.

Book Services and the EU Citizen

    Book Details:
  • Author : Frank S Benyon
  • Publisher : Bloomsbury Publishing
  • Release : 2013-04-12
  • ISBN : 1782250956
  • Pages : 230 pages

Download or read book Services and the EU Citizen written by Frank S Benyon and published by Bloomsbury Publishing. This book was released on 2013-04-12 with total page 230 pages. Available in PDF, EPUB and Kindle. Book excerpt: The importance of services in the EU economy has increased exponentially in the last decades as have the number and scope of EU rules, both those liberalising the provision of services and those protecting their recipients or consumers - the passengers, patients, viewers and bank depositors. However, these consumers, in their capacity as citizens, are increasingly disillusioned with the EU and its institutions. This book, written by practitioners, academics and advocates before the European Court, reflects on these developments, examining rules in numerous service sectors, from the capping of roaming call charges upheld in the Vodafone decision, through health care, to the requirement for air carriers to care for and compensate passengers approved in the generous Sturgeon judgment. The Court's positive approach may have been guided by a desire to consolidate the notion of EU citizenship, a status introduced, but without clear content, at Maastricht. The book therefore considers whether these uniform, EU-wide, consumer rights may not form an important component of such European citizenship. The Commission's proposal to make 2013 European Year of Citizens seems to favour such a view.

Book Rules and Regulations of Brahmanical Asceticism

Download or read book Rules and Regulations of Brahmanical Asceticism written by Patrick Olivelle and published by State University of New York Press. This book was released on 1994-10-28 with total page 478 pages. Available in PDF, EPUB and Kindle. Book excerpt: Rules and Regulations of Brahmanical Asceticism is the critical edition and translation of a twelfth-century Sanskrit text written by Yadava Prakasaa, whose life and activities are of historical interest because, according to tradition, he was the teacher of the great Vais'n'ava theologian Ramanuja. This text is the oldest and most comprehensive example of medieval Sanskrit literature devoted to examining the duties of ascetics. Yadava Prakasaa is the only one who explicitly examines the thorny question of whether asceticism is a legitimate way of life for Brahmins. His topics include the people qualified to become ascetics; the rite for becoming an ascetic; the clothes and belongings of an ascetic; techniques of meditation; daily routines such as bathing, divine worship, and begging; proper conduct and etiquette; the manner of wandering; residence during the rains; expiatory penances; and the funeral. In his introduction, Patrick Olivelle examines the place of Yadava's text within the literary and institutional history of Brahman'ical asceticism. He discusses the origins of asceticism in India; its incorporation into the Brahman'ical mainstream; and its variations within Hindu sects, as well as in Buddhist and Jain traditions.
