Book excerpt: In the last two decades, multinational companies (MNCs) and global union federations (GUFs) have started to negotiate so-called global framework agreements (GFAs) which define minimum standards for labor conditions across their locations. This book focuses on the question why companies conclude GFAs, and identifies four groups of incentives: reduction and privatization of conflicts; public relations; promotion of equal competitive conditions; exogenous requirements and avoidance of public regulation. Based on an in-depth analysis of incentives considered to play a dominant role in the decision of companies to conclude GFAs, the book attempts to predict under which conditions GFAs can be expected to proliferate in the future.

Book excerpt: The international framework agreement is a relatively new instrument, used by global trade unions to respond to the impact of globalization on the business operations of companies operating worldwide. This way, they address an issue (inter-)national legislators and regulators have difficulties dealing with. This paper combines information available from existing literature with empirical data derived from interviews with relevant actors and desk research. It aims to analyse the present state of the international framework agreement as an instrument and to formulate conclusions with regard to conditions an international framework agreement has to fulfil in order to be able to meet its objectives. Although in general the emergence of international framework agreements is perceived as a positive development with the potential of improving fundamental working standards in global business operations, some comments have been made in literature that are confirmed and fleshed out by the empirical data presented in this paper. These comments address the substantive content of the agreement, and emphasise the relevance of implementation and monitoring processes, both in the contracting company's organisation and in its supply chain. They stress the relevance of investigating which parties are involved in these processes. If the issues identified in literature and in this paper are properly considered, the international framework agreement can be a compelling tool for global trade unions to pursue their aims. Unfortunately, research demonstrates that not all existing international framework agreements deal with these issues and some appear to achieve no direct practical impact at all.

Book excerpt: Global Union Federations have made significant progress in advancing Global Framework Agreements (GFAs) that create arenas for labor relations based on the Core Labor Standards of the International Labour Organization (ILO). These Agreements - signed and implemented by labor and management - are a means of setting minimum standards and organizing unions in Transnational Corporations (TNCs), to date largely European, and their worldwide production and supply networks. Despite the existence of robust institutions of labor relations in Europe and the strength of unions at TNC European headquarters, the implementation of Global Framework Agreements around the world has not been a routine exercise. Implementation in the US has resulted only from union pressure, both locally and through transnational collaboration involving unions from other countries and Global Union Federations. Although the study on which this paper is based did identify cases of good practice, most evidence points to the US as being a prime example of the existing deficiencies in the overall process of initiation, negotiation, implementation and conflict resolution. Most importantly, unions and management from the US were generally absent from the steps leading up to implementation and thus have claimed no "ownership" of a GFA. In light of the initiation of negotiations over a Transatlantic Trade and Investment Partnership (TTIP), it is essential for organized labor on both sides of the Atlantic to push for the inclusion of better and more comprehensive labor standards. Global Framework Agreements, based on the ILO Core Labor Standards, are an initial step in that direction.

Book excerpt: Global framework agreements (GFAs) - signed and implemented by labour and management - create arenas for labour relations that are based on the Core Labour Standards of the International Labour Organization (ILO). As such, they are a step towards building a transnational arena for global labour relations. Global Union Federations (GUFs) and their affiliates are driving this process, in particular by building transnational union networks (TUNs) that link unions and employee representatives at strategic nodes in the global production networks of transnational corporations. A special challenge of TUNs is that they must link unions that have differing labour relations systems as well as diverse political, cultural, and institutional contexts. Today, there are 85 active GFAs worldwide. In many cases their implementation "on the ground" is, however, limited. A comparative analysis of existing agreements shows that the key to the success of GFAs lies in their joint implementation by unions and management. In this respect, the full involvement of local level unions and management at all stages of the GFA process - from its initiation through to negotiations, implementation, and feedback - is crucial.

Book excerpt: A rapidly growing number of international unions are signing international framework agreements with multinational enterprises (MNEs), securing their commitment to respect fundamental workers' rights. This article explores the agreement between the global banana giant Chiquita and the Latin-American Coordination of Banana Workers Unions (COLSIBA) signed in 2001. The study shows how the banana unions employed innovative tactics of regional coordination and of alliances with nongovernmental organizations in the major consumer markets. Fieldwork on the implementation of the agreement further reveals an overall poor use of the agreement potential but also how the agreement was used as leverage for local organizing activities. This article argues that such international agreements show a promising way to defend and advance workers rights within MNEs, creating space for union organizing, collective bargaining, and social dialogue.
