This book presents a complex picture of legal problems surrounding the interpretation of the International Convention for the Regulation of Whaling and the role of its regulatory body, the International Whaling Commission. Contemporary whaling is about the competing interests of whaling nations (which are in the minority), non-whaling nations (which are in the majority) and indigenous peoples. Whales are covered by many international conventions, which has led to a very fragmented legal situation and does not necessarily ensure that whales are protected. This is one of the paradoxes of the contemporary international legal regime which are explored in this book. The book also examines the contentious issue of the right of indigenous peoples to whaling and questions whether indigenous whaling is very different from commercial practices.

"Whaling in Japan" seeks to broaden the terms of reference by providing a wider, objective analytic framework for examining this issue and the political actors and forces in Tokyo - the government, the bureaucracy and the Institute of Cetacean research - that create, control and implement Japan's policy and continue to shape the debate. Through the encouragement of political myths, the manipulation of public opinion and ironically, even by using the actions of the anti-whaling movement to its own advantage, pro-whaling forces have created a domestic consensus that allows Tokyo's whaling policies to continue to expand relatively unchallenged even as stockpiles of unsold whale meat build up in Japanese warehouses. "Whaling in Japan" focuses on the gap between the political myths and the reality of Japan's whaling policy and sheds light on seldom discussed aspects of the political and decision-making structures that support it. Morikawa also examines how Japan has used diplomacy and aid gradually to expand international support for its whaling policies at the International Whaling Commission (IWC) and considers the longer term future of whaling as environmental awareness grows apace.

Both are conspicuous representatives of wildlife conservation. The issues of whaling and the ivory trade are closely linked, both legally and politically, in many ways; some obvious, and some surprising. The treatment of both whales and elephants will be politically and legally contentious for years to come, and is of great significance to conservation in general. This book examines the current state of international environmental law and wildlife conservation through a comparative analysis of the treatment of whales and elephants. In particular, it describes the separate histories of international governance of both whales and elephants, presenting the various treaties through which conservation has been implemented. It is shown that international environmental law is influenced and shaped by important political actors – many with opposing views on how best conservation, and sustainable development, principles are to be implemented. Modern environmental treaties are changing as weaknesses and loopholes are exposed in older, and possibly outdated, treaties such as the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) and the International Convention for the Regulation of Whaling (ICRW). Such weaknesses can be seen in the efforts made by some states to circumvent or weaken CITES and the International Whaling Commission and to resume commercial whaling, and further in the efforts of countries to resume trade in ivory. The argument is made that the Convention on Biological Diversity could be used to begin reconciling opposed views and to focus conservation efforts. The argument is made that effective conservation of species cannot be achieved through individual treaties, but only through a synergistic approach involving multilateral environmental agreements – 'ecosystems of legal instruments'.

Sightings of pilot whales in the frigid Nordic waters have drawn residents of the Faroe Islands to their boats and beaches for nearly a thousand years. Down in the tropics, around the islands of St. Vincent and the Grenadines, artisanal whaling is a younger trade, shaped by the legacies of slavery and colonialism but no less important to the local population. Each culture, Russell Fielding shows, has developed a distinct approach to whaling that preserves key traditions while adapting to threats of scarcity, the requirements of regulation, and a growing awareness of the humane treatment of animals. Yet these strategies struggle to account for the risks of regularly eating meat contaminated with methylmercury and other environmental pollutants introduced from abroad. It presents central findings on the link between contestation and norm robustness based on four detailed, contemporary case studies - the torture prohibition, the responsibility to protect, the duty to prosecute institutionalized in the International Criminal Court, and the moratorium on commercial whaling. It also includes two historical case studies - privateering and the transatlantic slave trade. This scholarly volume provides in-depth knowledge on contestation and robustness dynamics of central international norms. Having meticulously collected relevant data and conducted extensive qualitative coding, the authors clearly demonstrate that norms are likely to weaken when challengers contest the validity of a norm's core claims but remain robust when they contest a norm's application and contestation does not become permanent. These important findings, comparatively presented here for the first time, are crucial for understanding the much-discussed problems of the contemporary liberal international order. The insights provided establish how different types of challenges will affect global governance mechanisms and which conditions are most likely to create fundamental change.
