The focus of this research will be on laws and reforms enacted since country's decentralization process that started after the 1982 debt crisis. Particular attention will be paid to the 1992 National Water Law and why its model of horizontal, participatory management is largely failing. The city of Oaxaca will be used as a case study. Solutions will be proposed to address both administration challenges and economical ways to improve water access and treatment.

Book excerpt: This project examines the impact of intergovernmental relations and municipal capacity on the process of decentralization of water services through a subnational examination of water service delivery in central Mexico. Conventional thinking is that local governments must have already developed an institutional and administrative capacity in order to provide adequate public services. Others argue that capacities will be developed through the process of giving local governments authority over service provision. Additionally the unique political history of Mexico, a one-party dominant federal government until 2000, provides an interesting opportunity to examine the effects of intergovernmental relations on the provision of public services. Mexico's decentralization reforms have been both hailed as a move in the right direction by international lending institutions and criticized by academics and political observers as an attempt by the historically centralized government to retain control by decentralizing without delegating the necessary authority. The primary research question of this study is: how do intergovernmental relations and municipal capacity influence the process of decentralizing water services, the form that decentralization takes, and the quality of the services provided? Related to this question is whether local governments need to have already developed capacity in order to adequately provide public services or whether this capacity can be acquired "on the job", what impacts political affiliations at the local and state level make, and how various federal and state institutions related to water have shaped the process of decentralization and ultimately the quality and coverage of local water services. These questions and considerations will be addressed through an examination of water services at the municipal and state level in the Mexican states of Guanajuato, San Luis Potosí, and Zacatecas, Mexico.

Water availability in Mexico is polarized, with abundant rainfall and large rivers in the south, and desert-like conditions in the north. The central region, which is the most industrialized, is overpopulated. Mexico City pours millions of cubic meters of “blackwater” into the northern valley daily and receives its clean water from the south. To address these unsustainable conditions, the world's 4th biggest water treatment plant went into operation in 2018. The water infrastructure and governance must satisfy the demands of all sectors, including agricultural, urban, and economic activities. At the same time, water resources are affected by drought, and climate change puts constraints on the supply. As such, regulation and monitoring are important when it comes to adherence to agreed plans and priorities. The book is divided into four sections. 1: Water Availability discusses quantitative aspects, such as supply, methods of calculation, and fracking. 2: Water Quality highlights pollution risks and diagnosis of water resources. 3: Water Allocation examines the sectoral demands and vulnerability due to unsustainable irrigation. 4: Water Governance and Management focuses on laws, urban rules, national parks, planning, and integrated water resources management, among other topics. Although it is also the wealthiest area of the country, its unreasonable size gives rise to issues that require prompt attention. The problem of supplying water to the urban region of Mexico City and the metropolitan area is extremely complex due to the interconnection it has with different factors such as public affairs, social conflicts, consequences for the environment, energy – water nexus, economic investments, among others. This research evaluates the problem of water supply by examining the key driving forces that impact reliability of the supply as perceived by residents. A literature review revealed that the water crisis in the region is closely coupled with many social and economic issues. Energy-water nexus connections are a significant driver in water governance activities because the majority of water agency budgets, estimated to be 80%, is directed to electric bills rather than mitigation, monitoring or maintenance. Yet these relationships are based on limited information from the field and, therefore this study takes initial steps to fill the gap in knowledge about water supply conditions by collecting ground truth data related to the observations and perceptions of resident via interviews and surveys. Results of surveys and responses from approximately 192 participants completed between July and August 2017 indicate that there are two different categories of water shortage in the Valle de Mexico. The first is related to non-mitigation of infrastructure failures, such as leaks and broken pipes, while the second is that water users do not conserve the resource when it is available. Interestingly, the second type of water shortage is exacerbated by the beliefs and perceptions of residents in the region because their behaviors reflect a pattern of overconsumption when water is present in the system. The result is an increase in periods without water supply in the system driven purely by use patterns. This result highlights the urgent need to better understand the mindset of users to guide future urban development. Improving understanding about the drivers behind water scarcity in the Valle de Mexico is useful in relation to the water sector, as well as all of the other sectors and aspects that will negatively impact the lives of residents. All the inhabitants of Mexico, regardless of their actual role, must become primary actors working together on this complex and often intimidating issue.
