Meeting this challenge requires the development of flexible regimes that have the potential to meet essential consumptive needs while restoring environmental flows. This book focuses on how water trading frameworks can be repurposed for environmental water recovery and aims to conceptualise the most appropriate role for law in supporting recovery through these frameworks. The author presents a comprehensive study of the legal frameworks in four jurisdictions: the States of Oregon and Colorado in the western United States; the province of Alberta in Canada; and the Murray-Darling Basin in Australia/Basin State of New South Wales. A close comparative analysis of these four jurisdictions reveals a variety of distinctive regulatory arrangements and collaborations between public and private actors. In all cases, the law has been deployed to steer and coordinate these water governance activities. The book argues that each regime is based on a particular regulatory strategy, with different conceptions of the appropriate roles for, and relationships between, various actors and institutions. Legal frameworks do not have the capacity to rationalise and provide an overarching and absolute solution to the complex environmental and governance issues that arise in the context of environmental water transactions. Rather, the role of law in this context needs to be reconceptualised within the paradigm of regulatory capitalism as establishing and maintaining the limits within which regulatory participants can operate, innovate and collaborate.

The MPs are concerned that the Draft Bill contains only a broad framework and leaves too much of the important detail to be decided by the regulator, Ofwat, or to be introduced through secondary legislation that receives less parliamentary scrutiny. In welcoming the opportunities for greater competition within the retail water sector (providing billing services) the MPs ask Government to get on with implementing changes that would reduce flooding - many of which were recommended nearly five years ago. The MPs highlight the importance of managing our water resources sustainably and efficiently. They recommend that encouraging sustainable development be elevated to a primary duty of the regulator and that the Government brings forward legislation to enable the abstraction regime to be reformed by 2022. In addition they recommend implementation of existing provisions on bad debt and encouraging greater use of water meters, both of which would lower customers' water bills. However, the report concludes that the Government needs to undertake further work before embarking on "upstream" competition, which would enable companies to compete in the supply of water.

Vast areas of forests have been destroyed, and irrigated lands now produce 40% of the food supply. Due to depletion of groundwater reserves and an increase in population, irrigated area per capita is declining. Consequently, the irrigation of additional alluvial lands is a strategic necessity for all of humankind. Much of the alluvial lands cannot be made productive without prior development of water resources through flood control, drainage, and irrigation. The production of electricity through hydropower and the production of alcohol fuel from irrigated crops, as has been practiced for many years in Brazil, can slow the increase in carbon emissions. Such diverse developments are typically not separable; rather, they must be considered as integral parts of a comprehensive development plan. The conservation of natural resources and increasing productivity of irrigated lands are also strategic necessities. Much of the current technology is highly transferable and crop yields can be significantly increased on lands already under irrigation.The authors have worked in many countries in connection with resource inventories, teaching, and the planning, development and use of irrigation as a tool for increasing production and providing employment. They have written extensively and have been honored for their achievements. They have considerable experience with everything from primitive low-technology irrigation developments to highly developed irrigation in the USA and in dozens of countries around the world. Both of the authors have dedicated their careers to teaching, research, and consulting in agricultural irrigation and water resources development and planning.
