Book excerpt: Legal Ramifications of the First World War. Originally published: New York: E.P. Dutton and Company, 1915. xxviii, 578 pp. The authors argue that the First World War effectively ended the existing system of international law, a system that was already in decline due to the growing economic and political interdependence of states. These changes have created a new set of problems that will provide the basis of a new system of international law when the war ends. In addition to supplying an intellectual framework for this new system, Baty and Morgan address practical topics, such as international arbitration, and more abstract issues, such as the clash between nationalism and cosmopolitanism. "[V]ery good reading....It is a thoughtful book." --T.S.W., Yale Law Journal 19:313-314. THOMAS BATY [1868-1954] taught law at Oxford University and was a joint secretary of the International Law Association. In 1915, the year War was published, Baty became the foreign legal advisor to the Japanese government and moved to Japan. He is also the author of the well-known work, International Law (1909) and International Law in Twilight (1954). J.H. MORGAN [1876-1955] was a Liberal candidate for Parliament in 1910. A legal editor of the Encyclopedia Britannica (14th edition), he was professor of constitutional law at the University of London and legal adviser to the War Crimes Commission at Nuremberg from 1947 to 1949.

Available in PDF, EPUB and Kindle. Book excerpt: "War by Agreement presents a new theory on the ethics of war. It shows that wars can be morally justified at both the ad bellum level (the political decision to go to war) and the in bello level (its actual conduct by the military) by accepting a contractarian account of the rules governing war. According to this account, the rules of war are anchored in a mutually beneficial and fair agreement between the relevant players-- the purpose of which is to promote peace and to reduce the horrors of war. The book relies on the long social contract tradition and illustrates its fruitfulness in understanding and developing the morality and the law of war"--

Book Law and War

Download or read book Law and War written by Austin Sarat and published by Stanford University Press. This book was released on 2014-01-08 with total page 249 pages. Available in PDF, EPUB and Kindle. Book excerpt: Law and War explores the cultural, historical, spatial, and theoretical dimensions of the relationship between law and war—a connection that has long vexed the jurisprudential imagination. Historically the term "war crime" struck some as redundant and others as oxymoronic: redundant because war itself is criminal; oxymoronic because war submits to no law. More recently, the remarkable trend toward the juridification of warfare has emerged, as law has sought to stretch its dominion over every aspect of the waging of armed struggle. No longer simply a tool for judging battlefield conduct, law now seeks to subdue warfare and to enlist it into the service of legal goals. Law has emerged as a force that stands over and above war, endowed with the power to authorize and restrain, to declare and limit, to justify and condemn. In examining this fraught, contested, and evolving relationship, Law and War investigates such questions as: What can efforts to subsume war under the logic of law teach us about the aspirations and limits of law? How have paradigms of law and war changed as a result of the contact with new forms of struggle? How has globalization and continuing practices of occupation reframed the relationship between law and war?
