This book focuses on four socially grounded fields of legal knowledge: fiqh, codification, individual waqf cases, and everyday waqf-related knowledge. It combines textual analysis with ethnography and seeks to understand how Islamic law is approached, used, produced, and validated in selected topics of waqf law where there are tensions between ideals and pragmatic rules. The study analyses central Zaydī fiqh works such as the Sharḥ al-azhār cluster, imamic decrees, fatwās, and waqf documents, mostly from Zaydī, northern Yemen. In this book R. D. McChesney focuses on the major Muslim shrine at Balkh--once a flourishing city on an ancient trade route in what is now northern Afghanistan--and provides a detailed study of the political, economic, and social conditions that influenced, and were influenced by, the development of a single religious endowment. From its founding in 1480 until 1889, when the Afghan government took control of it, the waqf at Balkh was a formidable economic force in a financially dynamic region, particularly during those times when the endowment's sacred character and the tax privileges it acquired gave its managers considerable financial security. This study sheds new light on the legal institution of waqf within Muslim society and on how political conditions affected the development of socio-religious institutions throughout Central Asia over a period of four hundred years. Book excerpt: Using a combination of the comparative legal method and hermeneutics, this book reconciles Islamic law with English trust’s law in these two main areas. It does not find it necessary for one legal system to reign supreme over the other, as such solutions will be questioned by the internal subjects of the dominated legal system, undermining the efficacy of this study. Rather, reconciliation is a mutual step to congruence taken by both legal systems. In the area of perpetuities, the book finds that neither Islamic Waqfs must be perpetual, nor common law trusts must have a rule against perpetuities. Regarding ownership theories, the multiplicity of rendered theories in both legal systems presents more than one avenue of reconciliation. Overall, the study finds that private Waqfs and private trusts can be reconciled without undermining the internal hermeneutic standpoints of both legal systems.

In the introductory chapter to the law, which concerns its application, it is stipulated that commercial matters with regard to which specific federal laws are promulgated shall be subject to the provisions of these laws & to such provisions of the present law as do not conflict with them (Article 3). The main body of the law commences with definitions of what constitutes commercial activity: these persons who shall be deemed to be traders, & the conditions of eligibility to engage in trade. It sets out the requirements of accounting & record keeping which are obligatory for all traders. There is comprehensive legislation of a range of general commercial matters such as commercial houses, trade names, commercial data, commercial obligations & contracts, sale on deferred terms, sale at action, international sales, commercial pledges & deposits in public depositories. Following this there is detailed regulation of several of the most important specific areas of commercial activity including the different forms of commercial agency, commercial representation, brokerage & carriage of goods & persons. The large section of banking operations is systematic & exhaustive, as is the regulation of actions & transactions involving commercial & financial documents. The last section deals with bankruptcy, composition to avert bankruptcy, the procedures & administration of bankruptcy & its consequences. Article 196 states that the establishment of a Stock Exchange will be subject to the agreement of the Council of Ministers & promulgation of a Federal Law regulating the activity of the Exchange. The Law is presented in a comprehensive & consistent manner & is clear & accessible. An invaluable reference to all those who have business interests in or with the United Arab Emirates.

Yet, despite having a large number of children enrolled in the initiative, many are unaware of the true significance of being Waqf-e-Nau. The Essence of Waqf-e-Nau is a translation of a Friday Sermon delivered by the worldwide head of the Ahmadiyya Muslim Community, Hazrat Mirza Masroor Ahmad(at) on October 28th, 2016. In this sermon, His Holiness espouses the true essence of the Waqf-e-Nau initiative. The purpose is to raise children to be devotees of the Community, those who are willing to lay down their lives and spiritually attain lofty heights, just as the companions of the Holy Prophet Muhammad(sa) had done. Having a Waqf-e-Nau child does not deem any merit on its own. His Holiness stresses the point that these children are not special just by being Waqf-e-Nau. Rather, they will be seen as special by Allah only if they uphold their responsibilities and become true, ardent servants of Allah. Just as Hazrat Maryam(as) devoted her unborn child in the way of God, it is the parent’s duty to raise their children with the proper intention and sincerity.
