This manual is intended to assist fisheries managers, fishing gear manufacturers and the fisheries sector to meet the relevant international, regional or national obligations for gear marking. More specifically, it enables all stakeholders to comply with the specific gear marking requirements outlined in the FAO Code of Conduct for Responsible Fisheries, as well as in other international instruments and agreements. The Guidelines address the purpose and principles, the scope of application and the implementation of a gear marking system and its associated components, including reporting, recovery and disposal of ALDFG or unwanted fishing gear and commercial traceability of fishing gear. The Guidelines also contain special considerations for developing States and small-scale fisheries with a view to capacity development, as well as guidance on conducting a risk-based approach to implementing gear marking systems. The Guidelines are expected to assist States in meeting their obligations under international law, including relevant international agreements and related governance frameworks and the specific requirements for gear marking contained in FAO’s Code of Conduct for Responsible Fisheries. Les Directives favorisent la gestion de la pêche et peuvent être utilisées pour identifier les activités de pêche illégales, non déclarées et non réglementées (INDNR). Les Directives traitent de l'objectif et des principes, du champ d'application et de la mise en œuvre d'un système de marquage des engins et de l’ensemble de ses composantes, notamment la notification, la récupération et l'élimination des ALDFG ou des engins de pêche indésirables ainsi que de la traçabilité commerciale du marquage des engins de pêche. Les Directives contiennent également des considérations spéciales pour les États en développement et les pêcheries artisanales pour le renforcement des capacités, ainsi que des orientations sur le développement d'une approche fondée sur les risques pour la mise en œuvre de systèmes de marquage des engins. Asimismo, abordan las finalidades y principios, el ámbito de la aplicación y la implementación de un sistema de marcado las artes de pesca y sus componentes conexos, incluidas la presentación de informes, la recuperación y la eliminación de los ALDFG. Contienen, además, consideraciones especiales para los Estados en desarrollo y los pescadores artesanales con miras al desarrollo de capacidad, además de orientaciones para conducir enfoques basados en los riesgos para aplicar los sistemas de marcado de las artes de pesca. Se espera que estas Directrices ayuden a los Estados a cumplir sus obligaciones derivadas del Derecho internacional, incluidos los acuerdos internacionales relevantes y los marcos de gobernanza conexos, además de los requisitos específicos para el marcado de las artes de pesca, estipulados en el Código de Conducta de la FAO para la Pesca Responsable (CCPR).

All Nordic countries have participated in the network. Through a dedicated website (www.cnogear.org), workshops, seminars, conferences, films and social media, this project has helped to establish contacts both inside and outside the Nordic region, which can help reduce the challenges of marine litter from fishing activities. Among the numerous important findings that have been made over the course of the project, the report points out that fishermen in all the Nordic countries lack sufficient awareness of how they can and should contribute to a cleaner ocean. The report proposes a number of possible measures. Some of the measures may be suitable for all countries, but in general, there is no “one size fits all” solution.

Book excerpt: Abandoned, lost, or otherwise discarded fishing gear, alternately known as ALDFG or ghost gear is the most harmful form of marine plastic litter for marine animals and habitats. It also can impede safe navigation, mars beaches and reefs, and causes economic losses to fisheries and other marine-dependent industries across the globe. While current estimates of the amount of ALDFG in the ocean are not available, a growing body of evidence has documented high rates of ALDFG in fisheries around the world, with coincident costs to fisheries, harm to the environment, and safety risks. Because most fishing gear has significant plastic components, the negative impacts from ALDFG also include less direct but longer term impacts associated with other plastic pollution and microplastics including negative effects on biota, water quality and even human health. Advancing solutions to ALDFG on a global scale has gained momentum with the efforts of the FAO, the United Nations Environmental Program (UNEP), and the IMO through their multilateral fora (COFI, UNEA and MEPC); the publication and endorsement of the Voluntary Guidelines for the Marking of Fishing Gear (VGMFG); the IMO action plan to address marine plastic litter from ships; the creation of the Global Ghost Gear Initiative (GGGI); and the establishment of the Joint Group of Experts on the Scientific Aspects of Marine Environmental Pollution (GESAMP) Working Group 43. These efforts reflect the growing understanding that ALDFG is a considerable and damaging source of MPL in the ocean. With the publication of the VGMFG and the Best Practice Framework (BPF) for the management of fishing gear, there are now references for how to prevent loss of fishing gear and prevent harm from ALDFG. Focusing on two key recommendations of the VGMFG and the BPF, this report describes systems for fisher-led reporting and retrieval of lost fishing gear, identifies critical elements of successful programs, and recommends next steps for countries to develop successful programs.

Workshop participants reviewed existing measures for addressing fishing-related marine debris in particular ALDFG, considered best available information that supports further development of best practices for the management of fishing gear, discussed provisions required within international instruments and identify region-specific challenges, opportunities and priority needs. The main objective was to increase understanding and awareness of the Voluntary Guidelines for the Marking of Fishing Gear (VGMFG) and relevant best practice as outlined in the GGGI’s Best Practice Framework for the Management of Fishing Gear (BPF). The main output of the workshops were a set of recommendations to inform next steps to be taken towards the development of national action plans or strategies to align, as appropriate, policies, legislation, systems and operations to the provisions of the VGMFG and the BPF, which will support the implementation of regional action plans to address marine litter from sea-based activities, especially ALDFG.

The document refers to policy instruments and institutional frameworks that support the implementation of the guidelines and the conservation of marine mammals, in addition to awareness raising, communication and capacity-building actions, together with the special requirements of developing States. Finally, the guidelines address the future research and development needs for the prevention and reduction of marine mammal bycatch in capture fisheries.

Book excerpt: The fourteenth session of the Compliance Committee (CoC) of the General Fisheries Commission for the Mediterranean (GFCM) was held online on 21 May 2021. The Committee acknowledged the progress made in the implementation of intersessional activities. Concerning the status of compliance with GFCM decisions, the Committee decided to upgrade the compliance categories of some contracting parties and cooperating non-contracting parties (CPCs). More specifically, the European Union, Morocco and Turkey were upgraded to a fully compliant status, whereas Israel was upgraded to a partially compliant status. It also decided that the identification and clarification process would continue on the basis of a compliance assessment scheme which would streamline the detection of infringements and their severity. Several proposals on compliance advice to the Commission were presented and discussed. Finally, the Committee adopted its programme of work for the next intersession. La quatorzième session du Comité d’application de la Commission générale des pêches pour la Méditerranée (CGPM) s’est tenue en ligne le 21 mai 2021. Le Comité a pris note des progrès accomplis dans la mise en œuvre des activités intersessions. S’agissant de l’application des décisions de la CGPM, le Comité a décidé de faire passer certaines parties contractantes et parties non contractantes coopérantes dans des catégories de conformité supérieures. Plus précisément, le Maroc, la Turquie et l’Union européenne sont passés dans la catégorie correspondant à une situation de pleine conformité et Israël est passé dans celle correspondant à une situation de conformité partielle. Le Comité a également décidé que le processus d’identification et d’éclaircissements se poursuivrait sur la base d’un programme d’évaluation de la conformité qui permettrait de rationaliser la détection des infractions et l’évaluation de leur gravité. Plusieurs propositions d’avis en matière d’application à soumettre à la Commission ont été présentées et analysées. Le Comité a adopté son programme de travail pour la prochaine période intersessions.

Book excerpt: The growing quantity of plastic waste in the marine environment including abandoned, lost or otherwise discarded fishing gear (ALDFG) is a global problem. A particular feature of ALDFG is the potential of some gears to carry on fishing for many months or even years. The study examines legal responses to ALDFG in the context of marine fisheries. After discussing the nature of the problem of ALDFG and some of the reasons why fishing gear is abandoned, lost, or otherwise discarded, the study examines the response of the international community to ALDFG. A key finding is that ALDFG is at the same time, a fishing issue, a navigation problem (of vessel source pollution) and an environmental problem with the resulting involvement of FAO, IMO and UNEP as well as the UN General Assembly. After examining potential legal approaches to the problem, the study then describes the basic legal and institutional arrangements in four case study jurisdictions that have adopted legal measures to address ALDFG, namely Australia, the European Union and its Member States, Norway and the USA finding once again the tripartite responsibility of fisheries, navigation and environment ministries/agencies. The inter-sectoral nature of ALDFG suggests the need for a collaborative and coordinated approach. While not all of the case study jurisdictions make use of all ten of the individual legal measures identified, the case studies also clearly show that ALDFG is a problem that is susceptible to a legal response at the national or regional level including through the use of extended producer responsibility schemes, various reporting requirements and gear standards. Legal tools to address the problem of ALDFG clearly exist. The extent to which some, or all, of them are necessary or appropriate in a given context at national, regional or global level is not ultimately a legal question but a political one.

The authors hope that the study will provide an impetus for discussion about the use of agricultural plastics, their benefits and trade-offs, and ultimately stimulate action to reduce their potential for harm to human health and the environment.

The meeting was organized by FAO in response to the request from the Committee on Fisheries at its 33rd session in 2018 to develop technical guidelines on this subject. At the meeting the experts reviewed and discussed technical measures that can be applied for the reduction of bycatch of marine mammals in fisheries, including: time-area closures, acoustic deterrents, modifications to fishing gears and changes in fishing operations.
