Credit Nation examines how the drive to expand credit shaped property laws and legal institutions in the colonial and founding eras of the republic. In this major new history of early America, Claire Priest describes how the British Parliament departed from the customary ways that English law protected land and inheritance, enacting laws for the colonies that privileged creditors by defining land and slaves as commodities available to satisfy debts. Colonial governments, in turn, created local legal institutions that enabled people to further leverage their assets to obtain credit. Priest shows how loans backed with slaves as property fueled slavery from the colonial era through the Civil War, and that increased access to credit was key to the explosive growth of capitalism in nineteenth-century America. Available in PDF, EPUB and Kindle. Book excerpt: This volume is the first comprehensive history of the evolving relationship between American slavery and the law from colonial times to the Civil War. As Thomas Morris clearly shows, racial slavery came to the English colonies as an institution without strict legal definitions or guidelines. Specifically, he demonstrates that there was no coherent body of law that dealt solely with slaves. Instead, more general legal rules concerning inheritance, mortgages, and transfers of property coexisted with laws pertaining only to slaves. According to Morris, southern lawmakers and judges struggled to reconcile a social order based on slavery with existing English common law (or, in Louisiana, with continental civil law.) Because much was left to local interpretation, laws varied between and even within states. In addition, legal doctrine often differed from local practice. And, as Morris reveals, in the decades leading up to the Civil War, tensions mounted between the legal culture of racial slavery and the competing demands of capitalism and evangelical Christianity.

Borrowing has become a way of life for millions of families, and it is hard to imagine a time when charge accounts did not exist. Nonetheless, it would be a mistake to assume that, because a wallet filled with plastic instead of cash is a relatively new phenomenon, Americans have not been borrowers and lenders since the colonization of the New World. Author Peter J. Coleman proves otherwise. In one Form or another -- notes of hand, book credit, commercial paper, mortgages, land contracts -- settlers borrowed to pay their passage from Europe, to buy and clear land, to build and operate mills, to purchase slaves, and to gamble and drink. Debtors' prison awaited those who could not pay their debts, and a pauper's grave received the unfortunate who lacked the private means to feed and clothe himself in prison. While the debtors' prisons described in this book no longer exist, the author maintains that our credit-oriented society has yet to devise cheap, efficient, equitable, and humane methods of enforcing contracts for debt.

Book excerpt: In the recent past, enormous creative energy has gone into the study of American slavery, with major explorations of the extent to which African culture affected the culture of black Americans and with an almost totally new assessment of slave culture as Afro-American. Accompanying this new awareness of the African values brought into America, however, is an automatic assumption that white traditions influenced black ones. In this view, although the institution of slaver is seen as important, blacks are not generally treated as actors nor is their "divergent culture" seen as having had a wide-ranging effect on whites. Historians working in this area generally assume two social systems in America, one black and one white, and cultural divergence between slaves and masters. It is the thesis of this book that blacks, Africans, and Afro-Americans, deeply influenced white's perceptions, values, and identity, and that although two world views existed, there was a deep symbiotic relatedness that must be explored if we are to understand either or both of them. This exploration raises many questions and suggests many possibilities and probabilities, but it also establishes how thoroughly whites and blacks intermixed within the system of slavery and how extensive was the resulting cultural interaction.

Jeff Broadwater provides a comprehensive account of Mason's life at the center of the momentous events of eighteenth-century America. Mason played a key role in the Stamp Act Crisis, the American Revolution, and the drafting of Virginia's first state constitution. He is perhaps best known as author of the Virginia Declaration of Rights, a document often hailed as the model for the Bill of Rights. As a Virginia delegate to the Constitutional Convention in Philadelphia, Mason influenced the emerging Constitution on point after point. Yet when he was rebuffed in his efforts to add a bill of rights and concluded the document did too little to protect the interests of the South, he refused to sign the final draft. Broadwater argues that Mason's recalcitrance was not the act of an isolated dissenter; rather, it emerged from the ideology of the American Revolution.
