Book excerpt: El problema de la impunidad y la devaluación de los derechos de las mujeres que sufren violencia machista en las relaciones de pareja sigue presente en los sistemas penales europeos. La cuestión de fondo es qué diferencia a las violencias machistas en el ámbito de la pareja de otras violencias. Este tipo de violencias en el ámbito de la pareja no tienen nada que ver con lo que el ámbito penal se conoce como lesiones, sino que son “violencia de género, violencia machista, violencia contras la mujeres”. El “problema” no son las mujeres que denuncian o no denuncian, sino en qué medida el tratamiento penal persigue las conductas denunciadas y protege a las mujeres que sufren violencias. En contextos diversos veremos problemas comunes y soluciones alejadas, pero que coinciden en no estar todavía asegurando la libertad de las mujeres. Nuestro propósito es avanzar en la construcción de los derechos de las mujeres y denunciar que la insuficiente garantía del derecho a una vida libre de violencia es una atentado contra todas las mujeres, contra toda la ciudadanía y un lastre del Estado patriarcal.

The 1rst International SBRLab Conference, Finding solutions for a post-crisis society, is organized by the Social and Business Research Lab (SBRLab), Universitat Rovira i Virgili. It is as an international and virtual meeting point of interdisciplinary research and researchers. The purpose of this international conference is to bring together researchers from management, economics, political, social and legal disciplines in order to present and discuss new trends in their respective fields.

By specifically regarding the prevention and elimination of all forms of Violence Against Women, the book focuses on two European Mediterranean countries: Italy and Spain. The book first considers the chronological description and analysis of the main international documents, those belonging to the United Nations apparatus, followed by the analysis of the sources on Gender-Based Violence Against Women (GBVAW) of the Council of Europe and the European Union. The analysis of international documents guarantees an initial overview of the debate on GBVAW, following a top-down approach, from the UN to the national level. Successively, the focus is on both national sources as well as the level of government responsiveness in terms of policies on GBVAW in Italy and Spain, while also comparing the cases. The book adopts multimethod research based on qualitative text analysis; an examination of the level of national Government Responsiveness to GBVAW, and a series of in-depth interviews with targeted individuals. The final aim of this book is to understand how international (UN) and regional (CoE, EU) documents on GBVAW, along with the categories and expressions used within the documents, have contributed to different policies in countering GBVAW in Italy and Spain, while also highlighting the reasons why the two countries responded differently. Within a comprehensive international scenario, this book intends to create space for debate on possible future EU policies aimed at contrasting GBVAW.
