Under what conditions does lynching – lethal, extralegal group violence to punish offenses to the community – become an acceptable practice? We argue lynching emerges when neither the state nor its challengers have a monopoly over legitimate authority. When authority is contested or ambiguous, mass punishment for transgressions can emerge that is public, brutal, and requires broad participation. Using new cross-national data, we demonstrate lynching is a persistent problem in dozens of countries over the last four decades. Drawing on original survey and interview data from Haiti and South Africa, we show how lynching emerges and becomes accepted. Specifically, support for lynching most likely occurs in one of three conditions: when states fail to provide governance, when non-state actors provide social services, or when neighbors must rely on self-help.

Self-justice and legal self-help groups have been gaining importance throughout Africa. The question of who is entitled to formulate 'legal principles', enact 'justice', police 'morality' and sanction 'wrongdoings' has increasingly become a subject of controversy and conflict. These conflicts focus on the strained relationship between state sovereignty and citizens' self-determination. More particularly, they concern the conditions, modes and means of thelegitimate execution of power, and in this volume are seen as a diagnostics as to how social actors in Africa debate and practise socio-political order. State agencies try to bring vigilante groups under control by channelling their activities, repressing them, or using them for their own interests. Vigilante groups usually must struggle for recognition and acceptance in local socio-political spheres. As several of the contributions in the volume show, legal self-help groups in Africa therefore 'domesticate' themselves by, among other things, seeking legitimation, engaging in publicly acceptable non-vigilante activities, or institutionalizing what often began as a rather unrestrained and 'disorderly' social movement. Book excerpt: Despite being one of the world's most vibrant democracies, police estimate between five and ten percent of the murders in South Africa result from vigilante violence. This is puzzling given the country's celebrated transition to democracy and massive reform of the state's legal institutions. Where most studies explain vigilantism as a response to state or civic failure, in Contradictions of Democracy, Nicholas Rush Smith illustrates that vigilantism is actually a response to the processes of democratic state formation. In the context of densely networked neighborhoods, vigilante citizens often interpret the technical success of legal institutions-for instance, the arrest and subsequent release of suspects on bail-as failure and work to correct such perceived failures on their own. Smith also shows that vigilantism provides a new lens through which to understand democratic state formation. Among young men of color in some parts of South Africa, fear of extra-judicial police violence is common. Amid such fear, instead of the state seeming protective, it can appear as something akin to a massive vigilante organization. An insightful look into the high rates of vigilantism in South Africa and the general challenges of democratic state building, Contradictions of Democracy explores fundamental questions about political order, the rule of law, and democratic citizenship.

Book excerpt: America does not have a tradition of violence, but it does have a history of violence that can be traced through struggles and popular causes that date from colonial times to the modern era. The psychology of private violence by the American people is deeply ingrained in the concept of popular sovereignty. Repeatedly in American history, the peoples' deep-seated beliefs have led to confrontations and implementations of private will against the state and against groups viewed as harmful to existing values. In Vigilantism, Culberson argues for a clear-cut distinction between domestic terrorism, in which actions are taken that deny progression in the social order, and vigilantism, in which the actors are vigilant in all things social that could do harm to the progressive social order. He maintains not only that vigilantism has been the motivating social force in American politics since the founding of the United States but also that equating vigilantism with domestic terrorism denies the peoples' right to criticize and challenge the status quo or the direction of social policies. Culberson examines the American peoples' history of taking the law into their own hands and analyzes the use of this private power in three eras of American politics--Colonial, Populist, and Progressive--asserting that private power effected the transitions in creating, distributing, and maintaining socially acceptable values and norms. This extremely readable book, which takes an entirely new slant on the cyclical nature of political power and private power as a determinant of public policies, would be a stimulating addition to the reading lists of courses in Public Policy, American Government, Federalism, Criminal Justice, Political Theory/Philosophy, and others.

They trace the roots of the group in the region's border struggles during the Civil War, and examine the organization of anti-Bald Knobbers which sprang up to oppose them. Giant Nat Kinney founded the Bald Knobbers, and led them in their violent campaign for law and order. Andrew Coggburn wrote satirical songs to infuriate Kinney and the other vigilantes. Seventeen-year-old Billy Walker murdered an innocent family and was hanged by the beleaguered authorities. Five opponents of the Bald Knobbers vowed to kill Nat Kinney, and played cards to decide who would do the deed. Elmo Ingenthron was an Ozarks historian, and collected Bald Knobbers lore for more than thirty-five years. Mary Hartman is a veteran journalist and freelance writer.
