The term 'CSI-effect' was coined to signify a situation where people's views and practices have been influenced by such media representations, e.g. judges and jurors putting more weight on forensic evidence that has been produced with high-tech tools - in particular, DNA evidence - than on other kinds of evidence. While considerable scholarly attention has been paid to examining the CSI effect on publics, jurors, judges, and police investigators, prisoners' views on forensic technologies and policing have been under-explored. Drawing on a research sample of over 50 interviews carried out with prisoners in Portugal and Austria, this groundbreaking book shows how prisoners view crime scene traces, how they understand crime scene technologies, and what effect they attribute to the existence of large police databases on their own lives, careers, and futures. Peter Westen skillfully argues that the conceptual aspect accounts for a significant number of the difficulties that legislatures, courts and scholars have with consent in criminal cases; he observes that consent masquerades as a single kind of event when, in reality, it refers to diverse and sometimes mutually exclusive kinds of events. Specifically, consent is used in law to refer to three pairs of contrasting kinds of events: factual versus legal, attitudinal versus expressive, and prescriptive versus imputed. While Westen takes no position on whether the substance of existing defenses of consent in criminal law ought to be enlarged or reduced in scope, he examines each of these contrasting events and analyzes the normative confusions they produce.

He became a professional scholar when symbolic interactionism, sociological phenomenology and 'labelling theory' were taking form within criminology, and it is to those ways of viewing the social world that he still clings, although he has sought also to reflect critically upon them as time went by. Having completed a DPhil dissertation on debt collection as a moral career, and largely as a matter of serendipity, he was to take to empirical research just as policies for victims of crime were being developed by governments across the developed world and, finding himself embedded as a visitor in a Canadian federal criminal justice ministry when a federal-provincial task force was being mooted, he was able to embark on the first of a sequence of field studies of policy-making centred chiefly on victims. Those two interlaced preoccupations, theoretical and empirical, continually informed much, if not all, of his subsequent work, contributing to what has been, in effect, a running series of comparative ethnographies of government decision-making about the role of the victim in and around the criminal justice system.
