The first veterans treatment court was established in Buffalo, New York in 2008. These courts have spread across the United States. The state of Missouri has six veterans treatment courts in operation. This research is an observational study of the processes of the Missouri veterans treatment courts. On-site observations of the Missouri veterans treatment courts were conducted over a one year period. Qualitative methods including a matrix to categorize observations, and ethnographic techniques were used to collect and analyze data. Using Braithwaite's reintegrative shaming theory and the Ten Key Components of Veterans Treatment Courts developed by Judge Robert Russell, this study compared and contrasted the courts within the state of Missouri to the Buffalo Veterans Treatment Court. This research answers the questions of how the veterans treatment courts in Missouri operate, are they integrating and employing the key components of veterans treatment courts, and are they functioning in a way that promotes reintegration of the participant into society? This research lays a foundation for further study of the veteran treatment courts in the state of Missouri, as well as across the country by providing a framework in which to conduct observations of these courts. Additionally, increasing data collection, monitoring, and evaluating the data surrounding these courts has been identified as areas the Missouri veterans treatment courts can focus on in order to build the best practices and standards for these courts.

Book excerpt: The concept of treatment as an alternative to incarceration for veterans has become a rapidly growing phenomenon in the judicial system especially given an increase in justice-involved veterans. Veterans treatment courts have developed in response to this increase using a model and structure designed by previously established drug and mental health courts. With very limited research on these courts thus far, little is known about the clinical outcomes for participants in the court and the effectiveness of the court in connecting veterans to treatment. An evaluation of clinical outcomes and service use was conducted to compare how non-violent offenders and violent offenders fare in veterans treatment court. Moreover, future violence risk and psychopathy was evaluated between the two groups of offenders. Results indicate that both groups of offenders participating in veterans treatment court had similar outcomes. The lack of difference between the two groups suggests that excluding individuals with a violent offense history may be unwarranted. In addition, participation in veterans treatment court is associated with an increase in service use because service use for all participants increased after entry into the court. While additional research is needed on the effectiveness of these courts, the results are promising and important given the increasing development of these courts.

Book excerpt: "Throughout history, many civilizations asserted the need for a military, employed the military during conflict, and integrated the returning veteran into society. Some veterans require behavioral adjustment when returning from war to civilization. This can be a challenge for some veterans. Societal and economic burdens, along with physiological or psychological injuries, create challenges to assimilation. Studies, statistics and research also implicate the Department of Defense discharge from duty process, along with the Department of Veterans Affairs (VA) compensation and pension procedures as specific challenges to U.S. soldiers reentering society. Some veterans who fail to adapt to societal norms are arrested and enter the criminal justice system. Judges and probation officers took notice of an increasing trend of ignored symptoms and treatment for these veterans; thus, judicial employees and the National Association of Drug Court Professionals established Veteran Treatment Courts (VTC) based on their existing drug court model. Working with local VA counselors, VTC attempt to transition military veteran offenders from the criminal justice system into VA treatment centers for care and rehabilitation. As most VTC are less than three years old, statistics for the courts are limited. Pending federal legislation can improve the measurement and operation of VTC. Evaluation of the initial assessments indicates a low recidivism rate among VTC graduates. New Jersey state courts’ successful alternative, Veteran Assistance Program, proudly asserts a zero recidivism rate. Currently, VTC provide the best legal venue, as well as treatment and rehabilitation option for military veteran offenders"--Abstract.

Book excerpt: Additionally, I analyzed the national survey data using cluster analysis to discern whether a typology of VTCs exists, which yielded promising results. The second component's general goals were to understand the structure, process, participants, and implementation issues of a specific VTC. I conducted an in-depth case study of the Palm Beach County Veterans Treatment Court (PBCVTC) in two phases: 1) exploratory case study 2) implementation case study. I collected data through a series of interviews of the VTC personnel and participants and observations of the VTC team meetings and court sessions. I created a detailed portrait of the structure, function, process, the team dynamics, and implementation of this unique specialized court. Finally, I examined the PBCVTC within the national context, integrating the findings from both components (i.e., national survey and two-phase case study), which highlights the major findings of both studies. The dissertation culminates in a discussion of the importance of this research and suggested future research.

Book excerpt: In the wake of the wars in Iraq and Afghanistan, courts and social service systems across the country have begun establishing veterans treatment courts (VTC). The first VTC was created in 2004 and there are now over 300 in at least 35 states. Yet, their underlying assumptions have not been clearly articulated and their functioning and outcomes have not been well tested. These courts aim to reduce rates of incarceration and recidivism among justice-involved veterans and draw heavily on the structure and assumptions of drug and mental health courts. However, VTCs are different in important ways. Unlike other problem solving courts, VTCs actively express gratitude to criminal defendants (for past military service) and have the ability to connect participants to a socially-esteemed identity. Earlier problem solving courts have drawn on Tylers theory of procedural justice to predict a path from procedurally fair treatment and social bonds with court personnel through changes in social identity to increased perceptions of legal legitimacy and, ultimately, program completion and reduced recidivism. The present study tested a modified, version of Tylers theory that incorporates gratitude and focuses on veteran identity as the mediating construct between fair treatment and perceptions of legal legitimacy. A cross-sectional survey design was used with a convenience sample (N = 188) of participants in two Arizona VTCs. The results indicate that perceptions of procedural justice, perceived social bonds and receipt of gratitude are positively associated with both veteran identity and perceptions of legal legitimacy. Further, veteran identity was found to be a significant mediator between the first three constructs and legal legitimacy. Finally, neither recidivism risk nor race/ethnicity moderated the relationships. The study supports the importance of acknowledging past military service and enhancing the level of veteran identity among VTC participants. Implications for practice and future research are discussed.
