Book excerpt: For years, the disability compensation claims process has been the subject of concern and attention by the Department of Veterans Affairs (VA), Congress, and veteran service organizations (VSO), due in part to long waits for decisions and the large number of claims pending a decision. As GAO and other organizations have reported over the last decade, VA has also faced challenges in improving the accuracy and consistency of disability decisions. GAO was asked to examine (1) trends in VA's disability compensation claims processing at the initial claims and appeals levels and (2) actions that VA has taken to improve its disability claims process. To do this, GAO reviewed and analyzed VA performance data, budget submissions, program documents, and external studies and interviewed VA officials and VSO representatives. GAO recommends that the Secretary of Veterans Affairs direct (1) VBA to collect data on redistributed claims to help assess the effect of workload redistribution, (2) VBA and the Board of Veterans' Appeals to establish a plan with criteria for assessing whether ECA should be widely implemented, and (3) VBA to develop a plan with criteria for assessing whether its pilot reorganization of claims processors should be expanded. VA agreed with the recommendations, and noted plans to address them.

Book excerpt: 21st Century System for Evaluating Veterans' Disability Benefits recommends improvements in the medical evaluation and rating of veterans for the benefits provided by the Department of Veterans Affairs (VA) to compensate for illnesses or injuries incurred in or aggravated by military service. Compensation is a monthly cash benefit based on a rating schedule that determines the degree of disability on a scale of 0 to 100. Although a disability rating may also entitle a veteran to ancillary services, such as vocational rehabilitation and employment services, the rating schedule is out of date medically and contains ambiguous criteria and obsolete conditions and language. The current rating schedule emphasizes impairment and limitations or loss of specific body structures and functions which may not predict disability well. 21st Century System for Evaluating Veterans' Disability Benefits recommends that this schedule could be revised to include modern concepts of disability including work disability, nonwork disability, and quality of life. In addition to the need for an updated rating schedule, this book highlights the need for the Department of Veterans' Affairs to devote additional resources to systematic analysis of how well it is providing services or how much the lives of veterans are being improved, as well as the need for a program of research oriented toward understanding and improving the effectiveness of its benefits programs.

Book excerpt: Pursuant to a congressional request, GAO reviewed the Department of Veterans Affairs' (VA) efforts to improve its claims processing operations, focusing on the effectiveness of planned changes to veterans affairs regional offices' (VARO) claims processing structures and procedures. GAO found that: (1) VA has taken steps to ensure that VARO implement the changes necessary to improve overall service to veterans; (2) VA needs to implement the Blue Ribbon Panel's recommendations to improve disability claims processing; (3) VA has developed several model claims processing structures designed to reorganize staff so that fewer resources are devoted to clerical functions; (4) the models will serve as a framework for implementing other initiatives such as improving claims folder management and the use of evidence received by telephone or fax; (5) VA is also developing regulations and training materials to encourage VARO to adopt these improvement initiatives; (6) VARO have been given significant flexibility to implement initiatives in ways they believe are appropriate; (7) VA may not have a sound basis for determining what additional changes need to be made for guiding future improvements because it has not developed adequate plans for evaluating the merits of the various initiatives; and (8) VA does not have a formal mechanism to disseminate information about the effectiveness of regional initiatives and other VARO experiences with these initiatives.

Book excerpt: The United States has long recognized and honored the service and sacrifices of its military and veterans. Veterans who have been injured by their service (whether their injury appears during service or afterwards) are owed appropriate health care and disability compensation. For some medical conditions that develop after military service, the scientific information needed to connect the health conditions to the circumstances of service may be incomplete. When information is incomplete, Congress or the Department of Veterans Affairs (VA) may need to make a "presumption" of service connection so that a group of veterans can be appropriately compensated. The missing information may be about the specific exposures of the veterans, or there may be incomplete scientific evidence as to whether an exposure during service causes the health condition of concern. For example, when the exposures of military personnel in Vietnam to Agent Orange could not be clearly documented, a presumption was established that all those who set foot on Vietnam soil were exposed to Agent Orange. The Institute of Medicine (IOM) Committee was charged with reviewing and describing how presumptions have been made in the past and, if needed, to make recommendations for an improved scientific framework that could be used in the future for determining if a presumption should be made. The Committee was asked to consider and describe the processes of all participants in the current presumptive disability decision-making process for veterans. The Committee was not asked to offer an opinion about past presumptive decisions or to suggest specific future presumptions. The Committee heard from a range of groups that figure into this decision-making process, including past and present staffers from Congress, the VA, the IOM, veterans service organizations, and individual veterans. The Department of Defense (DoD) briefed the Committee about its current activities and plans to better track the exposures and health conditions of military personnel. The Committee further documented the current process by developing case studies around exposures and health conditions for which presumptions had been made. Improving the Presumptive Disability Decision-Making Process for Veterans explains recommendations made by the committee general methods by which scientists, as well as government and other organizations, evaluate scientific evidence in order to determine if a specific exposure causes a health condition.

Book excerpt: Under the direction of the Veterans Benefits Administration (VBA), 58 regional offices of the Department of Veterans Affairs receive and process veterans' compensation and pension disability claims. Responding to a GAO survey, 55 regional offices reported 238 practices that they believe have improved the accuracy of their disability decisions and remand rates. GAO grouped these into four areas: (1) efforts to improve staff training, guidance, or accountability; (2) changes in the supervisory or staffing structure; (3) efforts to develop evidence accurately and fully; and (4) efforts to communicate more effectively with veterans. VBA has taken some steps to identify potentially promising practices but has neither followed up on this effort nor developed a system for evaluating such practices and disseminating the results to regional offices. Regional offices reported various practices that they believe have helped improve their claims-processing performance, but regional office and VBA officials agreed that it would be helpful if VBA evaluated and identified best practices so that regional offices could use their limited resources to try only the most promising ones. VBA is in the initial stages of planning a system for evaluating promising practices but has not established specific time periods for developing and implementing it.
