Des phénomènes tels que l’allongement de la durée de la vie, l’urbanisation des populations, la difficulté d’entrée sur le marché du travail ou encore l’éclatement des modèles familiaux traditionnels marquent notre monde contemporain et impliquent la disparition d’anciennes solidarités et l’apparition de nouvelles solidarités redessinant les relations entre générations, posant alors le problème du sort des personnes les plus fragiles : les enfants, les malades, les handicapés et, surtout, les personnes âgées. – Quel est alors le rôle de la famille et des collectivités dans la protection de ces personnes ? – Quels rapports entre solidarités publiques et solidarités privées ? – Quels sont les droits et libertés reconnus aux personnes que l’âge, la maladie ou le handicap, placent en situation de dépendances ? Telles sont les questions au cœur de cet ouvrage. The importance of the human, economic and social issues caused by the question of generations’ solidarities led the International Society of Family Law to choose this theme for its XVIth World Congress (Lyon, July 19-23rd 2011). More than 200 speakers from 50 countries studied these questions from the legal angle, but also philosophic, economic and anthropological. This work collects a part of these papers about two great issues: the child, as the center of family solidarities; and the support for elders by family. Phenomena such as increasing life expectancy, population urbanization, labor-market entry barriers, decline of traditional family patterns, mark in depth our contemporary world and involve old solidarity disappearance and new solidarity emergence, reshaping relations between generations while bringing up the problem of the fate of the most vulnerable: children, the sick, disabled, and especially elderly people. – What then is the role of families and communities in protecting these people? – What is the relationship between public and private solidarity? – What are the rights and freedoms of people placed by age, illness or disability in a dependence situation? These are the issues addressed by the authors of this book.

Arguing that such a procedure would allow a society to democratically control the extreme limits of material wealth and poverty, the author forecasts that such a system will create strong economic incentives while reducing the present undesirable and expensive social problems associated with the maldistribution of wealth. Book excerpt: If the twentieth century was only focused on the complementarity and the opposition of market and state, the twenty-first century has now to deal with the prominence of the third sector, the emergence of social enterprises and other solidarity hybrid forms. The concept of civil society organisations (CSOs) spans this diversity and addresses this new complexity. The first part of the book highlights the organizational dimensions of CSOs and analyses the growing role of management models and their limits. Too often, the study of CSO governance has been centered on the role of the board and has not sufficiently taken into account the different types of accountability environments. Thus, the conversation about CSO governance rises to the level of networks rather than simple organizations per se, and the role of these networks in setting the agenda in a democratic society. In this perspective, the second part emphasizes the institutional dimensions of CSO governance by opening new avenues on democracy. First, the work of Ostrom about governing the commons provides us new insights to think community self-governance. Second, the work of Habermas and Fraser opens the question of deliberative governance and the role of public sphere to enlarge our vision of CSO governance. Third, the concepts of substantive rationality and economy proposed respectively by Ramos and Polanyi reframe the context in which the question can be addressed. Lastly, this book argues for a stronger intercultural approach useful for the renewal of paradigms in CSOs research. This book has for objective to present a unique collective work in bringing together 33 authors coming from 11 countries to share perpectives on civil society governance and will be of interest to an international audience of researchers and policy-makers.

EXTRACT We wanted to have a personality of international calibre, espousing different political systems across the world. But we also wanted to bring a good teacher into the fold filling students with enthusiasm, able to lead them to develop their study projects, to establish their vocation as researchers and even to train personalities active in every day life, in fact to promote a European conscientiousness. We know that Mario Telò has perfectly fulfilled these many wishes, in particular through his commitments towards his colleagues as well as his very active role as member and President of the Institut d’études européennes – Institute of European Studies (IEE-ULB), but also through the support that he has given numerous researchers who have completed brilliant doctoral theses under his supervision. It is difficult to pay him tribute, however, as Mario Telò has engaged in and still engages in multiple and international academic activities. We have lost count of the number of foreign invitations that have been extended to him as well as his numerous speeches to defend and to explain the need for a European area. Mario Telò knows better than anyone that European values still need to be defended, that European studies cover several aspects, not just the political integration process in Europe but also the analysis of the behaviour of actors, decision-makers and citizens. We know that the ‘EU acquis’ is often temporary and several times the work has to be redone, as the difficulties of functioning with twenty-eight member states, and soon to be twenty-seven member states, show. The European Union does not always respond to the democratic deficit, the political integration approach needs to show the usefulness and expected benefits of European cooperation essential to its existence in a very tense global context. The energy of Mario Telò, his creativity, his international engagement, his academic openness will always be essential to the ULB. A member of the Académie Royale de Belgique [Royal Academy of Belgium], in the Classe des Lettres et des Sciences morales et politiques [section of letters and moral and political sciences], Mario Telò will always find the opportunity to express his analyses and proposals to get through the currently very troubled time of Europe’s and the world’s evolution.
