Book excerpt: Without the Canadian mediation between the two world blocs in 1947, UN resolution 181(II) to partition Palestine would likely have failed to secure the two thirds majority necessary for adoption by the General Assembly. In fact, the Canadians were among the main initiators of the partition plan and the establishment of a Jewish state. Tauber demonstrates that this Canadian involvement was not an official government policy, but rather a private initiative of some high-ranking Canadian foreign service officials who believed partition to be the only practicable solution for the Palestine question. Thus, due to humanitarian concerns, these officials followed an independent policy against the express will of their prime minister. The results would forever change the history of the Middle East. Tauber explores this little known aspect of Canadian foreign policy. Canada's under secretary of state for external affairs, Lester Pearson, assisted by other foreign service officials, decided on his own accord which policy to follow in this instance. Based upon many original Canadian, British, American, UN, and Israeli documents, this study shows that Pearson's motivation was not the desire to make Canada a middle power involved in international affairs, as some scholars of Canadian international affairs have previously argued. Instead, the impact of the Holocaust drove these officials to break ranks with their superiors at home to support the establishment of a Jewish state in Palestine.

Book excerpt: By 2017, it was estimated that over 40 million people were displaced within their own countries by conflict and violence across at least 56 countries worldwide. Solutions to the epidemic of forced internal displacement are frequently premised on the return of internally displaced persons (IDPs). Indeed, as a characteristic need of IDPs, such returns benefit from a special protection framework developed by IDP protection instruments such as the Guiding Principles. However, the legal status of those instruments remains ambiguous, generating attendant questions about the congruity of the IDP return framework with existing international law. Moreover, limited knowledge exists on its practical implementation. As a result, both inter-national agencies and individual scholars have repeatedly issued urgent calls for comprehensive and grounded theoretical investigation into this topic. This book answers those long-standing calls for research by presenting a detailed study of the return of conflict-afffected IDPs under international law.

Ralph Bunche wrote these lines to his wife in 1949, during the armistice talks on Rhodes. A year later, he was awarded the Nobel Peace Prize for his success in ending the 1948 Arab-Israeli war. Ralph Bunche and the Arab-Israeli Conflict provides a comprehensive study of Ralph Bunche’s diplomatic activities on the Palestine question. Bunche was at the centre of the story from the referral of the issue to the United Nations in 1947 until the signing of the armistice agreements that ended the war. He began as advisor to UNSCOP and then headed the secretariat of the commission tasked with implementing partition. Later, after serving as the senior aide to UN mediator Folke Bernadotte, he was appointed to replace the Count after the latter’s assassination. Using extensive archival materials (some of it revealed here for the first time), this book addresses central questions, such as the relationship between Bunche’s African American identity and his diplomatic endeavours, and the complexities of his outlook on the Arab-Israeli conflict. Drawing on detailed archival research on the parallel histories of human rights and neoliberalism, Jessica Whyte uncovers the place of human rights in neoliberal attempts to develop a moral framework for a market society.In the wake of World War Two, neoliberals saw demands for new rights to social welfare and self-determination as threats to ‘civilisation’. Yet, rather than rejecting rights, they developed a distinctive account of human rights as tools to depoliticise civil society, protect private investments and shape liberal subjects. Honing in on neoliberal political thought, Whyte shows that the neoliberals developed a stark dichotomy between politics, conceived as conflictual, coercive and violent, and civil society, which they depicted as a realm of mutually-beneficial, voluntary, market relations between individual subjects of rights. In mobilising human rights to provide a moral language for a market society, neoliberals contributed far more than is often realised to today’s politics of human rights.

Book excerpt: States reject inequality when they choose to ratify the International Covenant on Economic, Social and Cultural Rights (ICESCR), but to date the ICESCR has not yet figured prominently in the policy calculus behind States' international economic decisions. This book responds to the modern challenge of operationalizing the ICESCR, particularly in the context of States' decisions within international trade, finance, and investment. Differentiating between public policy mechanisms and institutional functional mandates in the international trade, finance, and investment systems, this book shows legal and policy gateways for States to feasibly translate their fundamental duties to respect, protect, and fulfil economic, social and cultural rights into their trade, finance, and investment commitments, agreements, and contracts. It approaches the problem of harmonizing social protection objectives under the ICESCR with a State's international economic treaty obligations, from the designing and interpreting international treaty texts, up to the institutional monitoring and empirical analysis of ICESCR compliance. In examining public policy options, the book takes into account around five decades of States' implementation of social protection commitments under the ICESCR; its normative evolution through the UN Committee on Economic, Social and Cultural Rights, and the Committee's expanded fact-finding and adjudicative competences under the Optional Protocol to the ICESCR; as well as the critical, dialectical, and deliberative roles of diverse functional interpretive communities within international trade, finance, and investment law. Ultimately, the book shoes how States' ICESCR commitments operate as the normative foundation of their trade, finance, and investment decisions.
