The book argues that the international nuclear export controls have developed in a sub-optimal way as a result of a non-proliferation collective action problem. This has resulted in competition among suppliers, owing to the absence of an overarching effective system of control. While efforts have been undertaken to address this collective action problem and strengthen controls over time, these measures have been inherently limited, it is argued here, because of the same structural factors and vested interests that led to the creation of the problem in the first place. This study examines international controls from the beginning of the nuclear age and early efforts to control the atom, up to more recent times and the challenge posed by Iranian and North Korean nuclear ambitions. Drawing on a rich body of original archival research and interviews, the book demonstrates that the collective action problem has restrained cooperation in preventing nuclear proliferation and that gaps persist in the international nuclear trade control regime. This book will be of much interest to students of nuclear proliferation and arms control, security studies, and International Relations.

Featuring contributions from a number of eminent international scholars of nuclear history, intelligence, espionage, political science and Cold War studies, An International History of the Cuban Missile Crisis reviews and reflects on one of the critical moments of the Cold War, focussing on three key areas. First, the volume highlights the importance of memory as an essential foundation of historical understanding and demonstrates how events that rely only on historical records can provide misleading accounts. This focus on memory extends the scope of the existing literature by exploring hitherto neglected aspects of the CMC, including an analysis of the operational aspects of Bomber Command activity, explored through recollections of the aircrews that challenge accounts based on official records. The editors then go on to explore aspects of intelligence whose achievements and failings have increasingly been recognised to be of central importance to the origins, dynamics and outcomes of the missile crisis. Studies of hitherto neglected organisations such as the US Defense Intelligence Agency (DIA) and the British Joint Intelligence Committee (JIC) both extend our understanding of British and American intelligence machinery in this period and enrich our understanding of key episodes and assessments in the missile crisis. Finally, the book explores the risk of nuclear war and looks at how close we came to nuclear conflict. The risk of inadvertent use of nuclear weapons is evaluated and a new proposed framework for the analysis of nuclear risk put forward. This stalemate endangers the preservation of established, guiding legal principles, as well as the sustainability of the parts of outer space that humans utilize. The discrepancy between norm creation, technological advancement, and the ecosystem of novel actors could generate serious consequences for future space activities and the nature of international relations. Besides the return of old rivalries in a New Cold War, new activities and actors emerging amidst a legal void emphasizes the risks of the stalemate: unstable peace, fragile cooperation, uneven technological development, and uncertain eco-sustainability. The prolonged legal stalemate cannot be treated simply as an academic question, for it has broader political and economic implications of growing strategic relevance. Unresolved issues in international space law could threaten the survival of space as a global common, thus it is essential that the ability of the norm-creation mechanism of UN COPUOS is equipped to address the ongoing changes and provide for adequate global governance. This book evaluates the current legal state and sheds light on potential future prospects, offering an overview of the political context within which it developed, providing an assessment of the selected successful examples in international law, and analyzing lessons learned. It makes recommendations for how the UN COPUOS legal apparatus should be modified in order to ensure that future space activities are possible beyond anarchy, greed, and ecological irresponsibility, and to ensure that the principle of the peaceful uses of outer space remains the governing norm.

Book excerpt: The fact that the Montego Bay Convention has been only ratified by 37 States at present and that it will be some time before the 60 ratifications required by Article 308 are achieved has not prevented states from acting in accordance with the rules drawn up by the Conference. Close on one hundred states have established either exclusive economic zones broadly modelled on Part V or 200-nautical-mile fishery zones and drawn on the principles laid down for exploiting living resources. Although these laws have been formulated unilaterally by states, international custom, since the judgement by the International Court of Justice in the Fisheries Case of 18 December 1951, is derived from concordant national rules. This shift began even before the Conference ended, and has been consolidated since then. Moreover, the régime governing the sea-bed beyond the limits of national jurisdiction defined by Part XI, which was the stumbling block of the Conference, is subject to transitional arrangements on the basis of two resolutions adopted in the Conference's Final Act, one providing for the establishment of a Preparatory Commission and the other on the preliminary activities of pioneer investors. This two-volume work, an earlier edition of which appeared in French, has been written by a team of experts of international renown. It presents an analysis of the Convention with an additional Chapter on the legal régime governing underwater archaeological and historical objects.
