Available in PDF, EPUB and Kindle. Book excerpt: International Norm Disputes: The Link between Contestation and Norm Robustness offers a rich, comparative study of when and why contested international norms decline. It presents central findings on the link between contestation and norm robustness based on four detailed, contemporary case studies - the torture prohibition, the responsibility to protect, the duty to prosecute institutionalized in the International Criminal Court, and the moratorium on commercial whaling. It also includes two historical case studies - privateering and the transatlantic slave trade. This scholarly volume provides in-depth knowledge on contestation and robustness dynamics of central international norms. Having meticulously collected relevant data and conducted extensive qualitative coding, the authors clearly demonstrate that norms are likely to weaken when challengers contest the validity of a norm's core claims but remain robust when they contest a norm's application and contestation does not become permanent. These important findings, comparatively presented here for the first time, are crucial for understanding the much-discussed problems of the contemporary liberal international order. The insights provided establish how different types of challenges will affect global governance mechanisms and which conditions are most likely to create fundamental change.

Book Procedure at International Conferences

Download or read book Procedure at International Conferences written by Robbie Sabel and published by Cambridge University Press. This book was released on 1997-05-22 with total page 476 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book is a study of the rules of procedure of international conferences. It examines the legal basis of these rules of procedure and the history of their development since the end of the Second World War. The central part of the work consists of an examination of the practical application of rules of procedure at international conferences. The book also compares the application of rules at conferences with the relevant practice of the UN General Assembly, and the assemblies of international organisations such as the WHO and ILO. The book examines whether certain procedural rules and applications have become so well established that they have by now attained the status of customary international law.

Book UNSCOP and the Arab Israeli Conflict

Download or read book UNSCOP and the Arab Israeli Conflict written by Elad Ben-Dror and published by Taylor & Francis. This book was released on 2022-11-22 with total page 268 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides the first comprehensive account of the work of the United Nations Special Committee on Palestine (UNSCOP), constituted by the United Nations General Assembly in 1947 to study the situation in Palestine at the end of the British Mandate and make recommendations about its political future. Utilizing a wealth of archival documentation, some of it never before studied, Elad Ben-Dror explores the various aspects of UNSCOP’s activity to understand how it came to determine the fate of the country’s inhabitants. The book analyzes the methods and motivations of the various members, with special attention given to the personal viewpoint of each member of the committee. Through this Ben-Dror shows that the partition recommendation emerged after a long process of study, debate, and compromise that was very much dependent on the characters and circumstances of the individual members of the committee. UNSCOP and the Arab-Israeli Conflict will be a key text in understanding the role of UNSCOP in shaping the modern Middle East. It will be appropriate for scholars and students of political science, Palestine and Israeli history, the Arab-Israeli conflict, the UN and diplomacy, and conflict resolution.

Book UN Security Council Reform and the Right of Veto

Download or read book UN Security Council Reform and the Right of Veto written by Bardo Fassbender and published by BRILL. This book was released on 2023-12-21 with total page 436 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is a timely contribution to the present discussion of a constitutional reform of the United Nations, a discussion rekindled by the end of the cold War and the significant involvement of the UN in international peacemaking and peacekeeping since the Kuwait crisis. Like the new debate, the work focuses on the Security Council, its composition and possible enlargement, its decision-making process and competences, and its relationship with the General Assembly and the International Court of Justice. Particular regard is given to the right of veto of the permanent members of the Security Council, which is seen as the central, and most problematic, feature of the present constitution of the UN. The work describes and analyzes the reform discussion as it has taken place at the UN since 1991. The different proposals made by governments, NGOs and individual scholars are evaluated by applying a number of standards and concepts ensuing from a perception of the UN Charter as constitution of the international community. Thus, the study advances a comprehensive constitutional theory of the UN and redefines the place of the Charter in contemporary international law.

Book The Charter of the United Nations

Download or read book The Charter of the United Nations written by and published by Oxford University Press. This book was released on 2024-07-04 with total page 6378 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the third edition of this commentary on the Charter of the United Nations was published in 2012, the text of the Charter has not changed DL but the world has. Central pillars of the international order enshrined in the UN Charter are facing serious challenges, notably the prohibition of the use of force. Human rights, too, have come under increasing pressure, now also from contemporary information technology. Global warming poses fundamental challenges for the world community as a whole in its effort to stabilize global ecosystems. Fully updated, the commentary takes up these and other developments. It features new chapters on Climate Change and the Human Rights Council. The commentary remains the authoritative, article-by-article account of the legislative history, interpretation, and practical application of each and every Charter provision. Written by a team of distinguished scholars and practitioners, this book combines academic research with the insights of practice. It is an indispensable tool of reference for all those interested in the United Nations and its legal significance for the world community. The Commentary will be crucial in combining solid legal foundations with new directions for the development of international law and the United Nations in the twenty-first century

Book Sea Level Change and Maritime Boundaries

Download or read book Sea Level Change and Maritime Boundaries written by Antoine Grima and published by Taylor & Francis. This book was released on 2023-06-23 with total page 234 pages. Available in PDF, EPUB and Kindle. Book excerpt: Climate change is modifying, in varying measure, the coastal geography of States. The phenomenon is not temporary but is expected to carry on during the 21st century and beyond. A distinctive feature of modern international law is the concept of maritime zones. Each maritime area is subject to an intricate scheme of States’ rights and obligations. Coastal geography is a fundamental component of a long-standing method, developed and agreed upon between States, to establish the outward limits of these areas. A feature of this method is the baseline. In international law it is the only reference line from where the outward limits of maritime zones are measured. There are clear rules on how this is established along a coast. There is a concern amongst a number of States that rising sea water levels as a result of climate change may compel them to shift their baselines inward thus affecting the outward limits of their maritime zones. It is clear that the stability of maritime boundaries is put into question and this may bring about serious political, legal and economic repercussions. This concern may also affect the outcome of dispute settlement procedures before a competent international court or tribunal the purpose of which is to resolve overlapping maritime claims. Key questions emerge. What is the role played by coastal geography in the legal regime determining the outward limits of maritime zones? What are the consequences of changes to coastal geography? To what extent are dispute settlement procedures before a Court or Tribunal immune from this concern? Is international law able to address this? If so, in what way and what are its limits? What can be done to resolve this?

Book Health and Sustainability in the Canadian Food System

Download or read book Health and Sustainability in the Canadian Food System written by Rod MacRae and published by UBC Press. This book was released on 2012-07-18 with total page 309 pages. Available in PDF, EPUB and Kindle. Book excerpt: Civil society organizations are among the most vociferous critics of the modern food system. Yet even after decades of campaigns, governments have failed to address health and sustainability issues in a systematic way. New approaches are in order, and this volume showcases the research of experts from various disciplines who argue that solutions lie not just in lobbying elected officials but rather in initiatives at the subparliamentary level. Case studies on a range of topics, from breastfeeding and sustainable pest management promotion to programs such as Canada’s Action Plan on Food Security, tell a story of misguided campaigns and missed opportunities. Real change, this inspiring volume suggests, is possible. It will come when advocacy groups develop innovative strategies of influencing decision makers more resistant to public pressure: business lobbies well connected to government agencies, middle managers, and ministries unused to collaborating across departmental mandates.
