Dopo un’attesa durata troppi anni è stato finalmente pubblicato, infatti, il D.I. 30/11/2012 che indica la procedura da seguire per la valutazione dei rischi nelle piccole e microimprese e detta i tempi che segnano la fine dell’autocertificazione stessa. Il libro esamina nel dettaglio il decreto, mettendolo a confronto con gli obblighi generali del D.Lgs. 81/08 e suggerendo soluzioni applicative per l’effettuazione della valutazione con procedure standardizzate. Dalla valutazione dei rischi discendono direttamente o indirettamente la quasi totalità degli altri obblighi che vanno dalla formazione, alla fornitura dei DPI, alle attività di controllo e sorveglianza. Le stesse procedure di lavoro, gli acquisti, la progettazione e la messa in opera sono legate a questa attività. L’obbligo di valutare i rischi deriva dai principi generali di tutela del codice civile, ma è stata successivamente disciplinata nel dettaglio a partire dagli inizi degli anni ’90. Le imprese che occupavano fino a 10 addetti hanno potuto infatti avvalersi fin dal 1994 della facoltà di autocertificare l’avvenuta valutazione. Un’opzione criticata da chi la riteneva una scappatoia per non valutare i rischi e lodata da chi la riteneva un’opportuna semplificazione. Ora, con le nuove disposizioni, cambiano le regole anche per le microimprese. Di qui l’importanza di questo volume che è arricchito da un atlante per l’assegnazione dei fattori di rischio a 70 tipologie di microimprese e da 4 esempi utilizzabili di DVR redatti attenendosi alle indicazioni del decreto stesso. Gli esempi di DVR, realizzati con il modulo Procedure standardizzate (www.progetto-sicurezza-lavoro.it) sono contenuti anche nel Cd Rom allegato.

This volume summarises the main results obtained during the Project, with each Section addressing a different class of problems, to which many research Units have contributed.
