Available in PDF, EPUB and Kindle. Book excerpt: Pursuant to a congressional request, GAO examined the need for organizations within the Department of Veterans Affairs (VA) that are involved in processing claims to increase cooperation and coordination so that impediments to processing appeals can be identified and resolved. GAO found that: (1) legislation and Court of Veterans Appeals' rulings have forced VA to integrate new adjudication responsibilities into its already unwieldy adjudication process; (2) since 1991, the number of appeals awaiting Board of Veterans Appeals' action has increased by over 175 percent and the average processing time has increased by over 50 percent; (3) the VA legal and organizational framework makes effective interaction among autonomous VA claims adjudication organizations essential to fair and efficient claims processing; (4) although VA believes it has implemented efficient problem solving mechanisms, problems are going unidentified and unresolved; (5) unless consistent Board interpretations are developed, VA decisions will continue to be remanded, delaying benefits for some veterans and increasing VA workloads; and (6) unless VA clearly defines its adjudication responsibilities, it can not determine whether it has adequate resources to meet those responsibilities and whether new solutions may be needed.

In this book we will take your "homework" you completed using Book #1 and put that information to work for you in the form of your VA claim. We wrote this book to help you through the VA disability claim process. There are a lot of moving parts during this process- typically, we think of this timeframe from three months before your transition, whether for retirement or end of your service obligation, until about three months after your transition. In this book we will help you avoid the same pitfalls we went through when we navigated this process. You will learn how to prepare and submit your VA disability claim; you will learn how the VA claims process works; you will learn how your claim is decided and what that decision means to you; and finally, exactly how to appeal any claim you feel is not appropriate to your medical condition(s).In Section 1 of this book we will walk you the organizations who help you you're your disability claims process. Both the Veterans Affairs (VA) and Veterans Services Officers (VSO) from various organizations are the experts when putting together your claims, and we will talk about what to expect from them. In Section 2 we will discuss the 8-step VA claims adjudication process and describe each of the steps. We will also talk about how to check on the status of your claim during this process. In Section 3 we explain the VA disability compensation rating tables for you to have a clear understanding of why you have received or will receive your specific rating. In Section 4 we provide you with the current VA rating tables, so you can see what your disability percentage equates to in terms of monthly compensation. In Section 5 we discuss how to challenge your VA disability rating. In the event you receive a disability rating which you do not believe adequately represents your level of disability, you have the option to appeal your claim using a Notice of Disagreement (NOD). We will walk you through that process. In Section 6 we explain how Veterans who have been separated for over one year can prepare for a new claims, and what will be required to submit a Fully Developed Claim. In Section 7 we explain the difference between Concurrent Retirement Disability Payment (CRDP) and Combat Related Special Compensation (CRSC) benefits- what they mean to you, and how you go about applying for them. In Section 8 we will walk you through how to develop your CRSC Packet. We will walk you through the construction of a CRSC application with specific instructions, to ensure you have the greatest chance for getting the CRSC benefit you've earned. In Section 9 we provide you with a listing of legal professionals, broken down by State or Territory, who are ready to help you appeal any claim you believe is not appropriate for your disability. We have a proven method to help you maximize your claim. We also have proven methods to increase your chances of getting a favorable appeal. This book was released on 2019-01-28 with total page 28 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Law Library presents the complete text of the AM77 - Final Rule - Board of Veterans Appeals - Expedited Claims Adjudication Initiative - Pilot Program (US Department of Veterans Affairs Regulation) (VA) (2018 Edition). Updated as of May 29, 2018 The Department of Veterans Affairs (VA) is launching an initiative for accelerated claims and appeals processing at four VA facilities, based on voluntary participation by eligible claimants. The purpose of this initiative is to determine whether VA can expedite the processing of claims and appeals by obtaining claimants' waivers of certain statutory and regulatory response periods, and by utilizing the Board of Veterans' Appeals' (Board or BVA) statutory authority to pre-screen cases. VA's responsibility to fully develop and decide cases in a fair, accurate, and non-adversarial manner remains unchanged under this initiative. If this initiative is successful at the four trial sites, the data obtained may provide a basis for expanding some, or all, of the program nationwide, and ultimately help accelerate the processing of all claims and appeals. The parameters of the initiative are set forth in these regulations. This ebook contains: - The complete text of the AM77 - Final Rule - Board of Veterans Appeals - Expedited Claims Adjudication Initiative - Pilot Program (US Department of Veterans Affairs Regulation) (VA) (2018 Edition) - A dynamic table of content linking to each section - A table of contents in introduction presenting a general overview of the structure
