Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Book excerpt: Money laundering is one of the most prevalent crimes in the global community, and one in which several preventions exist within the United States, including the Bank Secrecy Act and the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism (USA PATRIOT). The following study examines the incidence and risks associated with money laundering, the potential effects for financial institutions, the history of compliance by financial institutions, the confusion surrounding anti-money laundering regulations, and the existing research relating to the perceived effectiveness of money laundering controls. Research was conducted with both managerial and non-managerial employee levels to determine whether anti-money laundering efforts were effective for financial institutions and to ascertain whether existing research was skewed having previously only surveyed the senior management level at banking institutions. The research found that financial institutions are generally in compliance with money laundering regulations, specifically the USA PATRIOT Act Title III S 352. The research conducted indicated that respondents answered similarly in comparison to the senior management research already in existence. The research identified some areas of concern, including the need to ensure that appropriate technology systems and training exists for financial institution employees as well as the need for enhanced penalties for failure to adhere to regulations as the potential revenue far outweighs penalties.

Book excerpt: The US Patriot Act, one of the most controversial laws of our time, consists of ten titles which, among other things: give federal law enforcement and intelligence officers greater authority (at least temporarily) to gather and share evidence particularly with respect to wire and electronic communications; amend federal money laundering laws, particularly those involving overseas financial activities; create new federal crimes, increase the penalties for existing federal crimes, and adjust existing federal criminal procedure, particularly with respect to acts of terrorism; modify immigration law, increasing the ability of federal authorities to prevent foreign terrorists from entering the US, to detain foreign terrorist suspects, to deport foreign terrorists, and to mitigate the adverse immigration consequences for the foreign victims of September 11; and authorise appropriations to enhance the capacity of immigration, law enforcement, and intelligence agencies to more effectively respond to the threats of terrorism. However, the American Library Association (ALA) Council declares that the ALA "considers sections of the USA PATRIOT Act . . . a present danger to the constitutional rights and privacy rights of library users. And civil rights activists have decried the government's interpretation of the act with respect to detaining individuals who may be guilty of nothing more than being born in the Middle East. This new reader presents a section by section analysis of the Act and highlights the provisions that are supposed to expire and when.

It flows from a consultation draft circulated by the Department of Justice, to which Congress made substantial modifications and additions. The stated purpose of the Act is to enable law enforcement officials to track down and punish those responsible for the attacks and to protect against similar attacks. The Act grants federal officials greater powers to trace and intercept terrorists' communications both for law enforcement and foreign intelligence purposes. It reinforces federal anti-money laundering laws and regulations in an effort to deny terrorists the resources necessary for future attacks. It tightens our immigration laws to close our borders to foreign terrorists and to expel those among us. Finally, it creates a few new federal crimes, such as the one outlawing terrorist attacks on mass transit; increases the penalties for many others; and institutes several procedural changes, such as a longer statute of limitations for crimes of terrorism. Critics have suggested that it may go too far. The authority to monitor e-mail traffic, to share grand jury information with intelligence and immigration officers, to confiscate property, and to impose new book-keeping requirements on financial institutions, are among the features troubling to some. The Act itself responds to some of those reservations. Many of the wiretapping and foreign intelligence amendments sunset on 31 December 2005. The Act creates judicial safeguards for e-mail monitoring and grand jury disclosures; recognises innocent owner defences to forfeiture; and entrusts enhanced anti-money laundering powers to those regulatory authorities whose concerns include the well being of our financial institutions.
