Book excerpt: This book examines the role of the international community in the handover of the Dutch colony of West Papua/Irian Jaya to Indonesia in the 1960s and questions whether or not the West Papuan people ever genuinely exercised the right to self-determination guaranteed to them in the UN-brokered Dutch/Indonesian agreement of 1962. Indonesian, Dutch, US, Soviet, Australian and British involvement is discussed, but particular emphasis is given to the central part played by the United Nations in the implementation of this agreement. As guarantor, the UN temporarily took over the territory's administration from the Dutch before transferring control to Indonesia in 1963. After five years of Indonesian rule, a UN team returned to West Papua to monitor and endorse a controversial act of self-determination that resulted in a unanimous vote by 1022 Papuan 'representatives' to reject independence. Despite this, the issue is still very much alive today as a crisis-hit Indonesia faces continued armed rebellion and growing calls for freedom in West Papua.

Book excerpt: Indonesia suffered an explosion of religious violence, ethnic violence, separatist violence, terrorism, and violence by criminal gangs, the security forces and militias in the late 1990s and early 2000s. By 2002 Indonesia had the worst terrorism problem of any nation. All these forms of violence have now fallen dramatically. How was this accomplished? What drove the rise and the fall of violence? Anomie theory is deployed to explain these developments. Sudden institutional change at the time of the Asian financial crisis and the fall of President Suharto meant the rules of the game were up for grabs. Valerie Braithwaite's motivational postures theory is used to explain the gaming of the rules and the disengagement from authority that occurred in that era. Ultimately resistance to Suharto laid a foundation for commitment to a revised, more democratic, institutional order. The peacebuilding that occurred was not based on the high-integrity truth-seeking and reconciliation that was the normative preference of these authors. Rather it was based on non-truth, sometimes lies, and yet substantial reconciliation. This poses a challenge to restorative justice theories of peacebuilding.

It is the friction that produces movement, action, and effect. Anthropologist Anna Lowenhaupt Tsing challenges the widespread view that globalization invariably signifies a clash of cultures, developing friction as a metaphor for the diverse and conflicting social interactions that make up our contemporary world. Tsing focuses on the rainforests of Indonesia, where in the 1980s and 1990s capitalist interests increasingly reshaped the landscape not so much through corporate design as through awkward chains of legal and illegal entrepreneurs that wrested the land from previous claimants, creating resources for distant markets. Written for a US-funded project on the local developments and following the modernization theory of Walt Whitman Rostow, Geertz examines in this book the agricultural system in Indonesia and its two dominant forms of agriculture, swidden and sawah. In addition to researching its agricultural systems, the book turns to an examination of their historical development. Of particular note is Geertz's discussion of what he famously describes as the process of "agricultural involution" in Java, where both the external economic demands of the Dutch rulers and the internal pressures due to population growth led to intensification rather than change.

The European Investment Law and Arbitration Review is the first law periodical specifically dedicated to the field of ‘European Investment Law and Arbitration’. The timing could not be better. The first EU integrated investment treaties with Canada (CETA), US (TTIP) and Singapore (EU-SING) are either negotiated or about to be signed and ratified by the EU and its Member States. These are “integrated” investment treaties in that they combine free trade agreement provisions with international investment agreement norms. Moreover, the Court of Justice of the EU (CJEU) is about to deliver its first judgments and Opinions directly relating to intra-EU BITs and the EU-SING FTA.
