Book The Development of Iran s Upstream Oil and Gas Industry

Download or read book The Development of Iran s Upstream Oil and Gas Industry written by Mahmoud Fard Kardel and published by . This book was released on 2020 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book critically examines different forms of petroleum contracts, the historical perspective of the oil and gas industry and the political economy of the petroleum development in Iran. In doing this, the author provides analysis of the concept of concession in oil and gas development. This is discussed through the main forms of concession contracts; namely, the classic concession contract (CCC) and the new concession contract (NCC). The book ties together much of the existing work on the history of oil and gas regulation in Iran and builds on that foundation to propose a coherent and balanced approach within the framework of the NCC. To consider the role of the NCC in developing national upstream oil and gas industry, comparative examples are drawn from countries currently using, or having previously used, NCC oil and gas contracts. The selected developed and developing countries are Brazil, Thailand, the United Kingdom, Australia and Norway. The analysis considers the extent to which the NCC has served to advance the objectives and national interests of the national governments in this industry. The book involves a comparative exploration of the utilisation of NCCs in other jurisdictions and synthesises a framework through which Iran may develop its underutilised oil and gas resources. Of interest to academics, students and practitioners throughout the world, this book focuses on the relevant aspects of Iran's Constitution and natural resource laws and makes recommendations for law reform to Iran's legal frameworks.

Book Commercial Contracts

Download or read book Commercial Contracts written by C. P. Thorpe and published by Kogan Page Publishers. This book was released on 1999 with total page 262 pages. Available in PDF, EPUB and Kindle. Book excerpt: The law of contract is the legal framework within which all business activity is conducted. It is vital for those in business to understand its basic principles and their commercial implications. Many businesses, however, evidently still believe that in the absence of a signed document no contract can exist, and may routinely sign documents that contain small print.Commercial Contracts provides an accessible guide to the basic principles of contract law and places them clearly and concisely in their commercial context. Using real examples, two practicing lawyers introduce English contract law, assuming no prior knowledge of the subject. They highlight areas where practical problems arise and examine possible solutions, with the aim of showing not only how to recognize these problems but how to deal with them in practice.

Book excerpt: In response to the primacy of English law as the lingua franca governing petroleum transactions, and the increased global demand for new sources of oil and gas, this fully updated new edition analyses the application of English law to contracts for project investment, financing, and development. The book provides practitioners and other parties with essential operational detail, as well as advising on the implications of English law on the interpretation of relevant provisions. The scope extends, unusually, beyond petroleum contracts made in the UK to cover all petroleum contracts worldwide, delivering exceptionally extensive coverage of this ever-growing sector for an international market. This work is a stand-alone practical guide on the application of English law to petroleum contracts, and provides a detailed and scholarly level of analysis, with reference to all relevant contracts and case law. Beginning with an introduction to the English legal system and the law of general contract, the author goes on to distinguish those characteristics that set petroleum contracts apart from others, including distinction between upstream, midstream, and downstream agreements. The contracts considered include those for the financing, management, sale, purchase and exchange of petroleum assets and interests (collectively called interest contracts), and contracts for the management, sale, purchase and exchange of petroleum quantities and petroleum storage, transportation and capacities (collectively called commodity contracts). Subsequent chapters introduce preliminary petroleum contracts and the obligation to negotiate, conditions precedent and subsequent, joint ventures, and the involvement third parties and the implications for privity in this context. Breaches and doctrines triggered by the impossibility of performance are set out in detail, alongside legal advice on damages, termination, liability allocation and equitable remedies. All relevant provisions are analysed in a final chapter of miscellaneous analysis, ensuring a truly comprehensive treatment of the sector. This new edition has been updated with new chapters on contract architecture and related issues and new sections on the Limitation Act and tolling, further assurances, quantum meruit and estoppel. Chapters have been updated in light of key cases on good faith and relational contracts, fiduciary duties and consequential loss recognitions, amongst others. As English law continues to grow in international importance, this is a key text for practitioners in a number of jurisdictions who are looking to draft contracts or handle international transactions under the umbrella of English law.

The first edition of this book has been selected for inclusion in Choice’s annual Outstanding Academic titles list. It has been rewarded for its excellence in scholarship and presentation, the significance of its contribution to the field, and its value as important treatment of the subject. The steps that lead to the production of oil and gas are diverse, complex and costly. They are diverse because the detection of oil and gas involves input from many specialties, ranging from geology to reservoir engineering. They are complex, as shown by the development of the job of the petroleum architect, who coordinates all the operations. They are costly, as the investments for exploration and production represent more than half of all investments in the oil and gas sector. Moreover, exploration is a risky activity, both from the technical and financial viewpoint: only one well in five produces marketable oil. Meanwhile, the areas for exploration and production are spread throughout the world. This book provides a complete overview of the stakes and challenges involved in oil and gas exploration and production. Following a historical review and a survey of the markets, the technical phases are covered, as are the evaluation of reserves, the estimation of investments and costs, the decision-making and control processes, and the accounting, legal and contractual environment for these activities. The book concludes with a discussion of the role of safety, and of environmental and ethical issues. This work, which is designed for readers concerned with the various aspects of the oil and gas upstream sector, is accessible to all. This second edition takes into account the huge changes in the oil and gas industry, particularly the large increases in oil prices, investments and costs observed since the first edition. This book is available in French under the title "Recherche et production du pétrole et du gaz". Contents : 1. Petroleum: a strategic product. 2. Oil and gas exploration and production. 3. Hydrocarbon reserves. 4. Investments and costs. 5. Legal, fiscal and contractual framework. 6. Decision-making on exploration and production. 7. Information, accounting and competition analysis. 8. Book Handbook for Upstream Oilfield Contract Administrators

Download or read book Handbook for Upstream Oilfield Contract Administrators written by Donald Butler and published by Createspace Independent Publishing Platform. This book was released on 2014-11-05 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book covers master service agreements, drilling contracts and construction agreements in the upstream oil and gas business with chapters on performance risk, incident risk and insurance, as well as negotiating, drafting and managing contracts. The author is a recognized expert with more than 30 years of experience in this area. This is an essential reference book not only for contract administrators, but also for purchasing groups, project managers and lawyers for both operators and contractors. The book provides critical information not taught in seminars, such as the chapter on the rules that apply when work is being performed, but there is no contract or only a very brief one. It analyzes how the region of the world in which a company operates influences which terms are the most heavily negotiated. It describes how insurance influences the drafting of various provisions related to allocating risk for personal injury, property damage and pollution. The book discusses not only the best practices in contract risk management, including limitation of liability, indemnity, insurance, and warranties, but also how they have evolved over time and the reasons for the evolution.
