Book excerpt: Through its detention observation, UNAMA found a compelling pattern and practice of systematic torture and ill-treatment at a number of NDS and ANP detention facilities. In many other facilities, UNAMA identified practices and documented allegations of abuse that raise serious concerns about the possible use of torture and ill-treatment. These allegations require further investigation and prompt action by all concerned. Use of interrogation methods, including suspension, beatings, electric shock, stress positions, and threatened sexual assault is unacceptable by any standard of international human rights law, Afghan law and professional standards for security forces. In particular, the abuses found against children in custody are a clear indication that NDS and ANP should undertake urgent reforms to ensure proper oversight and accountability within their ranks. To improve their human rights records and meet their human rights obligations, the NDS and the ANP should undertake serious systemic reform and cease any use of torture and ill-treatment. Internal education is needed to ensure that all NDS and ANP officials understand what constitutes torture, know that using such methods is illegal under the Constitution, criminal laws and international law and that any official using or condoning such practices will be prosecuted and disciplined. International support and assistance could play a key role. Decisions to provide donor support should be based on NDS and ANP taking concerted action to cease torture and abusive interrogation practices accompanied by appropriate safeguards. The provision of training in non-coercive interviewing techniques, modern prison management and administration and a basic understanding of national legal norms and international standards relating to prohibitions of torture and respect for legal safeguards and due process rights are essential to assisting NDS and ANP to move forward with institutional reform and modernization. In the context of transition of lead security responsibility from international military forces to ANSF, the imperative to ensure that NDS or ANP do not abuse detainees or provoke local grievance through mistreatment or arbitrary detention is particularly important.

The joint report by the UN Assistance Mission in Afghanistan (UNAMA) and the UN Human Rights Office, issued on the first anniversary of Afghanistan’s accession to the Convention Against Torture’s Optional Protocol, finds that nearly a third of conflict-related detainees interviewed provided credible and reliable accounts of having been subject to torture or ill-treatment. The report is based on interviews with 618 detainees held in 77 facilities in 28 provinces across the country between 1 January 2017 and 31 December 2018.

The report found credible evidence of torture at nine separate NDS facilities and a number of ANP locations, including beatings, suspension, electric shocks, and threats of physical violence and sexual abuse, which were routinely used to obtain confessions and other information. The report also details systematic violations of due process, and a persistent failure to hold Afghan officials accountable for abuse. The AIHRC and Open Society also documented cases in which U.S. transferred detainees were subjected to torture by NDS officials. The report calls on the Afghan government to fully investigate allegations of abuse, hold those responsible accountable, and ensure that AIHRC monitors have full, unfettered access to all detention facilities. The report also recommends that the ISAF and the United States ensure no detainees are transferred to Afghan detention facilities where they face a real risk of torture and that all U.S. forces in Afghanistan are subject to ISAF detainee transfer policies and monitoring.

This “forgotten war,” which started in 2001 with the US-led invasion of Afghanistan, has seen more than 212,000 people killed in war-related incidents. Whilst most of the news media shifted their attention to other conflict zones, this war rages on. Badalič has amassed a vast amount of data on the civilian victims of war from both sides of the Durand line, the border between Afghanistan and Pakistan. He conducted interviews in Peshawar, Quetta, Islamabad, Kabul, Jalalabad, and many other cities and villages from 2008 to 2017. His data is mostly drawn from those extensive conversations held with civilian victims of war, Afghan and Pakistani officials, human-rights activists and members of the insurgency. The book is divided into three parts. The first examines the impact the US-led coalition, Afghan security forces and paramilitary groups had on civilians, with methods of combat such as drone strikes and kill-or-capture missions. The second part focuses on civilian victims of abuses of power by Pakistani security forces, including arbitrary detentions and forced disappearances. The participation of the Bundeswehr in the International Security Assistance Force (ISAF) in Afghanistan was a significant exercise of the new security policy after German reunification. Given that linguistic actors construct knowledge through their personal actions, security policy is necessarily reflected in the relevant discourses of political elites. This publication attempts to combine Linguistic Discourse Analysis and Role Theory to construct a role-theoretic discourse analysis approach for German security policy study: The parliamentary debate is a prerequisite for the legitimizing mandate for the use of the German military abroad; the topos/topoi and (pro-and contra-) arguments construct the parliamentary debate discourse and influence decisions on military action abroad; the use of the topos/topoi and arguments is constructed by the role perceptions of the German political elite, and the final decisions are the result of behavioral preferences influenced by role perceptions.

Critics have argued that such partnerships have many perils, from enabling human rights abuses to seeding future threats. Policy makers, however, have sought to mitigate the risks of partnering with irregular armed groups. Militia group leaders in far-flung corners of these war-torn countries were subjected to background checks and instructed about international law and human rights, and their funding was cut when they crossed red lines. To what extent have such mechanisms curbed the dangers of proxy warfare, and what unforeseen consequences has this approach unleashed? Drawing on a decade of field research and hundreds of interviews with stakeholders, Erica L. Gaston unpacks the dilemmas of attempting to control proxy forces. She demonstrates that, although the tools U.S. policy makers used to constrain partners’ behavior increased in number and sophistication, they never fully addressed the range of political, security, and legal concerns surrounding these forces. Moreover, by shifting policy makers’ calculations, the use of proxy forces introduced additional moral hazards and may have enabled riskier decision making.
