Book excerpt: Excerpt from Unsoundness of Mind, in Its Legal and Medical Consideration Though for judicial purposes no other course is practical, yet in its operation, when necessity arises, and special facts in evidence are considered, the observation of Lord Cairns in Fulton v. Andrew 1 not unusually prevails: I should in this case, as indeed in all others, greatly deprecate the introduc tion or creation of fixed and unyielding rules of law which are not imposed by acts of Parliament. Merits rather than technicalities in uence the judicial mind, and so bridge over many otherwise impassable difficulties. Download or read book The Medical Jurisprudence of Insanity Classic Reprint written by John Macmichan Pagan and published by Forgotten Books. This book was released on 2017-10-22 with total page 340 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Medical Jurisprudence of Insanity Having confined himself so exclusively to the principles and details of his own profession, the Author is not without hopes, that this may be found the best recommendation of his work to those engaged in the study and practice of the law. The arrangement adopted has unavoidably led to some repetition, but the Author is satisfied, from his experience in teaching, that it is the one by which correct notions of the various forms of unsoundness of mind, and of the medico-legal consequences that result therefrom, can be most easily obtained. The Author is fully aware of the great difficulty, as well as importance of the subject which he has attempted to treat; he is sensible of the imperfect manner in which he must have executed the task he has undertaken, and if he has altogether failed, some one better qualified may be induced to supply the want of such a work in British medi cal literature. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Medical and Legal Relations of Madness: Showing a Cellular Theory of Mind, and of Nerve Force, and Also of Vegetative Vital Force This inquiry will aim to bring the question within the rules of induction which guide other inquiries, and to show that diseased affections of the mind, and of the senses, may be traced to injury or decay, or to an abnormal condition of the organic structures. The relation of madness with jurisprudence has hitherto been as intimate as with medicine; but inflexible legal codes, adapted to the interests of property and of material things, have proved inadequate to cope with the laws of physiology and life; and jurisprudence badly comprehends the interests of the lunatic. Book A Treatise on Mental Unsoundness

Download or read book A Treatise on Mental Unsoundness written by Francis Wharton and published by Forgotten Books. This book was released on 2017-12-15 with total page 816 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on Mental Unsoundness: Embracing a General View of Psychological Law But this was not the only circumstance that tended to an expan sion of the definition. Another influence, still more marked, had already prepared the public mind to treat as insanity much that was really only folly or guilty impulse. Between 1760 and 1764, Rousseau published his Contmt Social and Emile, works which, in the sentimental humanitarianism they inculcated, were the natural extreme reaction from the inhumanity of the prior absolutist regime. Rousseau flamed with a romantic admiration not merely for the liberty to do right, but for the liberty to do wrong. Even the grossest natural instincts were of divine origin, and should be nursed with delicate respect. Crime was something to which a man was impelled by his nature; else why should he indulge in crime? Heretofore all insanity was crime. Now all crime was to be in sanity. Sin was not to be viewed as horrible and odious, but as something abnormal, indeed, but provocative of curious regard and sympathy. And criminals were an interesting class of lunatics, who were especially consecrated to the restorative care of the state.
