Left without state protection people have sought to preserve their lives and property through vigilante groups and militias that pay scant attention to the law or human rights. Likewise, the state security forces, under pressure to cut crime and rebel activity, readily discard lawful procedures. Torture provides them with vital information, whilst extra-judicial executions save the need to go through the prolonged criminal justice system. After a general overview of the role of the rule of law in a democratic society, Bruce Baker provides five case studies that capture the current complex realities and their impact on the new democracies. The citizen responses considered are vigilantes in East African pastoral economies, The Bakassi Boys an anti-crime group in Nigeria and private policing initiatives in South Africa. The state responses are those of the Ugandan Defence Forces towards the Lords Resistance Army, the Senegalese army towards the Casamance secessionists and the Mozambique Police response towards criminals.

Book excerpt: In recent years, as peace between Israelis and Palestinians has remained cruelly elusive, scholars and activists have increasingly turned to South African history and politics to make sense of the situation. In the early 1990s, both South Africa and Israel began negotiating with their colonized populations. South Africans saw results: the state was democratized and black South Africans gained formal legal equality. Palestinians, on the other hand, won neither freedom nor equality, and today Israel remains a settler-colonial state. Despite these different outcomes, the transitions of the last twenty years have produced surprisingly similar socioeconomic changes in both regions: growing inequality, racialized poverty, and advanced strategies for securing the powerful and policing the racialized poor. Neoliberal Apartheid explores this paradox through an analysis of (de)colonization and neoliberal racial capitalism. After a decade of research in the Johannesburg and Jerusalem regions, Andy Clarno presents here a detailed ethnographic study of the precariousness of the poor in Alexandra township, the dynamics of colonization and enclosure in Bethlehem, the growth of fortress suburbs and private security in Johannesburg, and the regime of security coordination between the Israeli military and the Palestinian Authority in the West Bank. The first comparative study of the changes in these two areas since the early 1990s, the book addresses the limitations of liberation in South Africa, highlights the impact of neoliberal restructuring in Palestine, and argues that a new form of neoliberal apartheid has emerged in both contexts.

Based on commonly used fragility measures, South Africa (SA) is classified as a relatively stable state, yet rising violent crime, high unemployment, endemic poverty, eroding public trust, identity group based preferential treatment policies, and the rapid rise of the private security sector are all indications that SA may be suffering from latent state fragility. Based on a comprehensive view of security, this study examines the extent to which measures of political legitimacy and good governance, effectiveness in the security system – especially with respect to the police system – and mounting economic challenges may be undermining the stability of SA in ways undetected by commonly used measures of state fragility. Using a mixed-methods approach based on quantitative secondary data analysis and semi-structured interviews with government officials, security practitioners, and leading experts in the field, this study finds that the combination of colonization, apartheid, liberation struggle, transition from autocracy to democracy, high levels of direct and structural violence, stagnating social, political, and economic developments make South Africa a latently fragile state. Conceptually, the results of this research call into question the validity of commonly used measures of state fragility and suggest the need for a more comprehensive approach to assessing state fragility. Practically, this study offers a number of concrete policy recommendations for how South Africa may address mounting levels of latent state fragility.

Williard Sterne Randall documents an unremitting fifty-year-long struggle for economic independence from Britain overlapping two armed conflicts linked by an unacknowledged global struggle. Throughout this perilous period, the struggle was all about free trade. Neither Jefferson nor any other Founding Father could divine that the Revolutionary Period of 1763 to 1783 had concluded only one part, the first phase of their ordeal. The Treaty of Paris of 1783 at the end of the Revolutionary War halted overt combat but had achieved only partial political autonomy from Britain. By not guaranteeing American economic independence and agency, Britain continued to deny American sovereignty. Randall details the fifty years and persistent attempts by the British to control American trade waters, but he also shows how, despite the outrageous restrictions, the United States asserted the doctrine of neutral rights and developed the world’s second largest merchant fleet as it absorbed the French Caribbean trade. American ships carrying trade increased five-fold between 1790 and 1800, its tonnage nearly doubling again between 1800 and 1812, ultimately making the United States the world’s largest independent maritime power.
