Book excerpt: Since the demise of the doctrine of in loco parentis in the mid-1960's, the role that the United States government has played in matters of student conduct at postsecondary institutions has changed drastically. Although higher education has traditionally experienced minimal involvement from the outside world when it comes to disciplinary action against students, significant case law has emerged over the past forty years which has shifted the way colleges and universities deal with conduct issues. The most substantial change to the way colleges and universities handle such cases is in regard to the guarantee of due process rights in all disciplinary proceedings brought against students. Due process refers to the elements of proper notice of charges, an impartial hearing, and substantial evidence of the misconduct itself. In short, all student disciplinary proceedings must be "fundamentally fair" to the students being charged. In addition to the involvement of the legal system through case law, higher education has also been faced with numerous legislative mandates over the past forty years. This thesis examines one such piece of legislation, the Family educational Rights and Privacy Act of 1974, also known as the "Buckley Amendment" and "FERP A". The legal and social impacts of FERP A, along with its' associated amendments, are quite significant in relation to both students and student affairs professionals. Questions are raised about the effect that FERPA has on student privacy rights and how the legislation operates in relation to due process. Additionally, the challenges faced by student affairs professionals who attempt to understand and implement the regulations of FERP A are also considered. The unique element of this research lies with how it couples legislative mandates with various student affairs doctrines, attempting to find a balance between the two. As a result of this research, it is clear that risk management must be paired with a focus on student development and ethical practices in order for postsecondary institutions to successfully handle the demands of legislative involvement in modern higher education.
