Book excerpt: L'étude de la protection pénale de l'intégrité sexuelle des mineurs vise, d'une part à faire le point sur le droit applicable à la situation du mineur victime de violences sexuelles, d'autre part, à une réflexion prospective quant à l'émergence d'un droit pénal de l'enfance, in fine, d'un droit de l'enfance. En effet, et si parler de protection pénale de l'intégrité sexuelle des mineurs semble évoquer en premier lieu l'étude du droit répressif des violences sexuelles appliqué au mineur, la problématique dépasse largement cette seule perspective, en ce qu'elle renvoie à la fonction protective de la loi pénale, et à la notion d'intérêt protégé dont relèvent les acceptations d'intégrité sexuelle et de minorité. Dès lors, le domaine de réflexion s'élargit, pour considérer, en plus du strict droit pénal de fond, l'ensemble des dispositifs concourant à la réalisation de l'impératif de protection de l'intégrité sexuelle des mineurs, interrogeant sur leurs interactions. Dans cette perspective, la question de la protection pénale de l'intégrité sexuelle des mineurs se pose comme lieu privilégié d'une réflexion sur l'évolution du droit pénal, de la matière pénale, mais également de la justice pénale des mineurs, dont elle suggère la novation en permettant de dégager les critères de structuration d'un droit pénal de l'enfance. En ce sens, l'étude pose, d'une part, la nécessité d'une construction législative depuis des intérêts protégés clairement identifiés, d'autre part, un critère unique de reconstruction de la matière et des domaines qui s'y rapportent, tenant à la vulnérabilité du sujet concerné : le mineur.
