Ce contrat est bien organisé dans certaines législations telles que les législations française, allemande et espagnole. D'autres, telles que les législations algérienne, marocaine et tunisienne n'abordent que l'édition graphique et ignorent le fait que l'édition puisse concerner toute oeuvre susceptible d'être fixée sur un support quelconque. Ce contrat n'est pas organise par la loi en Egypte, comme dans la majorité des pays arabes. Ces derniers régissent ce contrat par les règles du droit commun. Mais elles ne sont pas adaptées à la nature propre de ce contrat et à l'influence du droit moral de l'auteur sur sa conclusion et son exécution. Cela apparaît à travers l'exigence de consentement personnel de l'auteur, même incapable pour conclure ce contrat. Elle appariait aussi à travers les principes de l'interprétation restrictive et de la prohibition de la cession globale des oeuvres futures. De même, ce contrat pose certaines obligations propres à chaque partie. Il engage l'auteur à délivrer le manuscrit à la date prévue, à corriger les premières épreuves et à garantir son fait personnel et le fait des tiers fondés sur son fait. L'auteur doit également signer et fournir le bon à tirer à l'éditeur à la date prévue pour qu'il puisse procéder à la fabrication de l'oeuvre. En contrepartie, l'éditeur est tenu d'exploiter l'oeuvre et de respecter le droit moral et pécuniaire de l'auteur sur cette oeuvre. Il doit également rendre compte à l'auteur de manière régulière, communiquer ses comptes avec toutes les justifications nécessaires et déposer le nombre d'exemplaires fixé par le législateur et selon les formules prévues à ce propos.
