It represents a multicultural approach to groundwater resources and their use. As a result, many of the fundamental concepts in hydrogeology are interpreted slightly differently in other countries. In fact, there are a number of hydrogeologic phenomena introduced that for the most part have not been presented internationally. Since various cultures review the science of hydrogeology with their own nuances, a substantial effort was made to provide classic references in the science of hydrogeology. The focus of the monograph was to present data and scientific principals, which are relevant to groundwater use in each of the countries. This monograph represents a major undertaking by hydrologists and hydrogeologists around the world. Although the fundamental groundwater resource data may change slowly over time, the groundwater use data is rapidly changing. Consulting hydrogeologists, engineers, chemists, geologists, biologists, health officials, and government environmental administrators will find this baseline document of substantial value. Book excerpt: This book undertakes a scholarly assessment of the state of the art of law and policy perspectives on groundwater and climate change at the international, regional and national levels. A particular focus is given to India, which is the largest user of groundwater in the world, and where groundwater is the primary source of water for domestic and agricultural uses. The extremely rapid rise in groundwater use in many Indian states has led to a growing groundwater crisis that they must address. The existing regulatory framework has not adapted to the challenges and fails to address any environmental concerns. On climate change, India has adopted a policy framework that makes the link with water, but no legislation has followed up to make the link operational. The subject matter of this book has been widely debated with regard to each of its main two components separately. Bringing these two domains together is what makes this book unique. The link between climate change and groundwater has been acknowledged to some extent, and there is growing interest in studying the impacts of climate change on (ground)water. Similarly, in water and environmental law and policy, increasing attention has been given to the study of climate change and groundwater legal and policy frameworks but generally separately. This book contributes to filling this knowledge gap by drawing on contributions from leading experts in the field of environmental and water law and policy who have been involved in climate change and/or groundwater research. The chapters in this book were originally published in a special issue of Water International.

Book excerpt: Nul n'est plus exposé que le médecin à tomber sous le coup des articles 319 et 320 du Code pénal, puisque, dans le cadre de son activité professionnelle, nécessairement, toute « maladresse, imprudence, inattention, négligence ou inobservation des règlements » est de nature à entraîner un dommage corporel. Or, on sait que depuis un arrêt de la Chambre civile en date du 18 décembre 1912, la jurisprudence affirme d'une manière constante l'identité de la faute civile et de la faute pénale. A l'époque contemporaine où, en matière civile, la faute n'apparaît plus, souvent, que comme un simple prétexte à assurer une réparation civile, pratiquement toujours supportée par l'assurance, la conséquence pratique de cette identité est le risque de voir s'installer une paradoxale, mais combien redoutable, autorité de fait du civil sur le criminel, préjudiciable à une bonne administration de la justice pénale. C'est pourquoi une partie importante de la doctrine contemporaine conteste le principe de l'identité des fautes. Mais, mené sur le terrain strict de la faute, le combat n'est pas mené sur un terrain propice. En effet, la logique impose qu'un même fait non intentionnel, nécessairement apprécié d'une manière objective — par référence à un standard — s'il est déclaré fautif en matière civile le soit aussi en matière pénale. En revanche, cette même logique impose d'exiger, pour retenir la responsabilité pénale l'existence d'un élément d'imputabilité dont la présence n'est pas nécessaire pour retenir la responsabilité civile. C'est donc au plan de la responsabilité que la dissociation doit se faire, et non au plan de la faute.
