Book excerpt: To encourage students to view wills, trusts, and estates issues from the standpoint of both planners and litigators, the authors include numerous questions that require students to think about ways to draft or plan to avoid litigation, while accomplishing clients' goals. While the book is intended for the basic wills and trusts course, it may also be used in advanced trusts and estates courses, as it includes chapters on estate planning, powers of appointment, advanced directives, and probate. The rules governing wills and trusts continue to be state-law-driven. The authors' philosophy is that students gain critical insights into complex issues by studying the laws of one jurisdiction as a whole. Florida law is a perfect platform for this endeavor because it has extensive probate and trust codes and significant case decisions addressing current and cutting-edge issues.

Download or read book Approaching Death written by Committee on Care at the End of Life and published by National Academies Press. This book was released on 1997-10-30 with total page 457 pages. Available in PDF, EPUB and Kindle. Book excerpt: When the end of life makes its inevitable appearance, people should be able to expect reliable, humane, and effective caregiving. Yet too many dying people suffer unnecessarily. While an "overtreated" dying is feared, untreated pain or emotional abandonment are equally frightening. Approaching Death reflects a wide-ranging effort to understand what we know about care at the end of life, what we have yet to learn, and what we know but do not adequately apply. It seeks to build understanding of what constitutes good care for the dying and offers recommendations to decisionmakers that address specific barriers to achieving good care. This volume offers a profile of when, where, and how Americans die. It examines the dimensions of caring at the end of life: Determining diagnosis and prognosis and communicating these to patient and family. Establishing clinical and personal goals. Matching physical, psychological, spiritual, and practical care strategies to the patient's values and circumstances. Approaching Death considers the dying experience in hospitals, nursing homes, and other settings and the role of interdisciplinary teams and managed care. It offers perspectives on quality measurement and improvement, the role of practice guidelines, cost concerns, and legal issues such as assisted suicide. The book proposes how health professionals can become better prepared to care well for those who are dying and to understand that these are not patients for whom "nothing can be done."

Book Commercial Law and Commercial Practice

Download or read book Commercial Law and Commercial Practice written by Sarah Worthington and published by Bloomsbury Publishing. This book was released on 2003-12-19 with total page 710 pages. Available in PDF, EPUB and Kindle. Book excerpt: This edited collection brings together leading scholars and practitioners from various jurisdictions with essays and commentaries co-ordinated around the theme of alignments and misalignments between commercial law and commercial practice. The purpose of the book is to prompt a more critical and constructive reassessment of current commercial law and its practices, and to instigate a more fruitful dialogue between academics, judges, law reformers and practitioners. The result is a series of provocative and challenging essays addressing an enormous range of problems that are of intimate concern to commercial practice. Some essays focus on broad themes, such as globalization and trust. Others address more specific issues, such as contract interpretation or constraining modern management. Yet another group targets special problems, such as dematerialisation or super-priority, in order to assess the success of commercial law in meeting commercial demands. The depth and breadth of issues addressed is a credit to the authors. Taken as a whole, the volume makes some pointed suggestions for improving the practices and processes, and indeed the future progress, of commercial law.

President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research and published by . This book was released on 1983 with total page 564 pages. Available in PDF, EPUB and Kindle. Book excerpt: Abstract: A comprehensive report by the US President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research addresses some of the most important and troubling ethical and legal questions in modern medicine for consideration by health care professionals, lawyers, and relatives of patients regarding the sensitive topic of voluntary cessation of life-sustaining therapy for the seriously ill. It was concluded that the cases that involve true ethical difficulties are much fewer than commonly believed and that the perception of difficulties primarily occurs because of misunderstandings about the dictates of law and ethics. It also is concluded that, while competent informed patients have the authority to decline or accept health care, others must act on the behalf of incompetent patients. The report urges that health care institutions develop and use internal review methods that permit exploration of all relevant issues. The 7 report chapters are grouped around 2 themes: the various aspects of making treatment decisions; and patient groups raising special concerns (e.g.: permanently-unconscious patients; seriously-ill newborns.
