Book Trademark Protection and Freedom of Expression

Download or read book Trademark Protection and Freedom of Expression written by Wolfgang Sakulin and published by Kluwer Law International B.V.. This book was released on 2011-01-01 with total page 424 pages. Available in PDF, EPUB and Kindle. Book excerpt: Trademark law grants right holders an exclusive right to prevent third parties from using a sign. This can readily be seen as the antithesis of freedom of expression, which arguably includes a right of third parties to non-exclusive use of a sign for a variety of purposes, ranging from informing consumers, to voicing criticism or to artistic expression. Drawing on cultural theory and– which has shown that society is involved in a constant struggle about shaping the meaning of signs (including trademarks) and– this highly original and provocative book contends that trademark law fails to sufficiently differentiate between commercial purpose and the social, political, or cultural meanings carried by one and the same sign. The author shows that the and‘functional approachand’ to justifying trademark rights taken in current jurisprudence and doctrine is deficient, in that it does not take sufficient account of the fact that trademark rights can restrict the freedom of expression of third parties. Specifically, the exercise of rights granted under the European Trademark Regulation and the national trademark rights harmonized by the European Trademark Directive can cause a disproportionate impairment of the freedom of commercial and non-commercial expression of third parties as protected by Article 10 of the European Convention on Human Rights (ECHR). The authorand’s in-depth analysis explores such elements as the following: o the economic and ethical rationales of trademark rights; o whether trademark rights under European law can be justified by these rationales; o how freedom of expression can serve as a limitation to trademark rights; o what level of protection such freedom of expression grants to third parties; o the role of trademarks of social, cultural, or political importance in public discourse; o chilling effects on public discourse that can be caused by the exercise of trademark rights; o the interpretation of provisions regulating the grant and revocation of trademark rights in light of freedom of expression; and o the interpretation of the scope of protection and the limitations of trademark rights in light of freedom of expression. In effect, the analysis serves to expand the focus of legislators, courts, and trademark registering authorities from the interests of trademark right holders, who seemingly are granted ever more protection, to the justified interests of third parties. The critical analysis of existing trademark law leads the author to clearly identify the areas of trademark law in which the law needs to be reinterpreted and the areas in which legislative action should be taken, with recommendations for a number of limitations that should aid legislators in drafting concrete amendments. The new insights and imperatives provided by this book are sure to prove useful to both courts interpreting existing provisions of trademark laws and to legislators who are faced with the challenges of drafting new rules or revising existing laws.

Book More Than A Movie

    Book Details:
  • Author : Miguel Valenti
  • Publisher : Routledge
  • Release : 2018-04-24
  • ISBN : 0429983166
  • Pages : 271 pages

Download or read book More Than A Movie written by Miguel Valenti and published by Routledge. This book was released on 2018-04-24 with total page 271 pages. Available in PDF, EPUB and Kindle. Book excerpt: In More Than a Movie, producer and entertainment attorney F. Miguel Valenti presents a compelling argument for the creative community to consider the consequences of its products, from movies to TV to the Internet. Valenti refrains from attacking the industries in which he himself works, but argues for reflection on the part of those who create media. More Than a Movie takes a pioneering first step toward outlining the issues in an insider fashion, and provides the tools to make ethical decisions about creating for the big and small screens. Edited by veteran media writer Les Brown and media consultant Laurie Trotta, More Than a Movie is written to stimulate debate in professional and academic arenas, and for the enjoyment of everyone who loves entertainment. The book contains a foreword by noted author and director Peter Bogdanovich, and commentary from producers Christine Vachon and David Brown. Mediascope, a Studio City, California-based media policy organization, commissioned the book upon discovering that ethical discussions seldom occur in film and television schools, although they are staples for studying law, medicine, business and journalism. Issues range from ethnic and gender stereotyping to excessive and gratuitous violence."It's not about censorship -- it's about having a responsibility for what we do," says author Valenti (no relation to MPAA's Jack Valenti). "The book outlines how we are helping to shape societal values and individual behavior with the artistic choices we make." A team of writers from across the nation offer essays: Neil Hickey, editor, Columbia Journalism Review ; Annette Insdorf, Columbia University; Ted Pease, professor and columnist; Jack Pitman, Variety; Martin Koughan, Emmy Award-winning documentarian. The essays in More Than a Movie are interspersed with stories of actual ethical dilemmas told by noted screenwriters, directors and other practitioners in interviews by Manhattan writer Laura Blum.

Book Philosophy of Education in the Era of Globalization

Download or read book Philosophy of Education in the Era of Globalization written by Yvonne Raley and published by Routledge. This book was released on 2009-12-04 with total page 413 pages. Available in PDF, EPUB and Kindle. Book excerpt: Terrorism, ethnocentrism, religious tension, competition over limited resources, war - these are just a few of the problems and challenges that have emerged in today's global economy. Globalization both implies and requires economic interdependence; and this should bring with it a heightened sense of the interconnectedness of the participating societies. But unfortunately, as recent events indicate, rather than our having formed a global community, today's society is more fragmented than ever. In light of this, education faces some formidable new challenges. How do we prepare future citizens for the world they will live in? How do we teach future generations to embrace the paradox of accepting the value of multiculturalism despite the conflicts it has produced? How do we instill religious tolerance in a time when fundamentalism has become inextricably tied with terrorism? How do we promote economic growth in the face of overpopulation and its depletion of resources? The authors of this collection of essays explore these and related challenges, and they suggest some novel ways of dealing with them.

Book Infinitely Full of Hope

Download or read book Infinitely Full of Hope written by Tom Whyman and published by Watkins Media Limited. This book was released on 2021-04-13 with total page 203 pages. Available in PDF, EPUB and Kindle. Book excerpt: A philosophical memoir about becoming a father in an increasingly terrible world – can I hope the child growing in my partner's womb will have a good-enough life? For Kant, philosophy boiled down to three key questions: “What can I know?”, “What ought I do?”, and “What can I hope for?” In philosophy departments, that third question has largely been neglected at the expense of the first two – even though it is crucial for understanding why anyone might ask them in the first place. In Infinitely Full of Hope, as he prepares to become a father for the first time, the philosopher Tom Whyman attempts to answer Kant’s third question, trying to make sense of it in the context of a world that increasingly seems like it is on the verge of collapse. Part memoir, part theory, and part reflection on fatherhood, Infinitely Full of Hope asks how we can cling to hope in a world marked by crisis and disaster.

Book Survivor Transitional Narratives of Nazi Era Destruction

Download or read book Survivor Transitional Narratives of Nazi Era Destruction written by Dennis B. Klein and published by Bloomsbury Publishing. This book was released on 2017-11-16 with total page 272 pages. Available in PDF, EPUB and Kindle. Book excerpt: Survivor Transitional Narratives of Nazi-Era Destruction: The Second Liberation examines the historical circumstances that gave rise in the 1960s to the first cohort of Nazi-era survivors who massed a public campaign focusing on remembrance of Nazi racial crimes. The survivors' decision to engage and disquiet a public audience occurred against the backdrop of the Frankfurt Auschwitz trial and the West German debate over the enforcement of statutory limitations for prosecuting former Nazis. Dennis B. Klein focuses on the accounts of three survivors: Jean Améry, an Austrian ex-patriot who joined the Belgian Resistance during the war, Vladimir Jankélévitch, a member of the French Resistance, and Simon Wiesenthal, who dedicated his life after the war to investigating Nazi crimes. As Klein argues, their accounts, in addition to acting as a reminder of Nazi-era endemic criminality, express a longing for human fellowshipThis contextual and interdisciplinary interpretation illustrates the explanatory significance of contemporary events and individual responses to them in shaping the memory and legacy of Nazi-era destruction. It is essential reading for students and scholars of the Nazi era and its legacy, genocide studies, Jewish Studies, and the history of emotions.

Book Free Speech on Campus

Download or read book Free Speech on Campus written by Erwin Chemerinsky and published by Yale University Press. This book was released on 2017-09-12 with total page 216 pages. Available in PDF, EPUB and Kindle. Book excerpt: Can free speech coexist with an inclusive campus environment? Hardly a week goes by without another controversy over free speech on college campuses. On one side, there are increased demands to censor hateful, disrespectful, and bullying expression and to ensure an inclusive and nondiscriminatory learning environment. On the other side are traditional free speech advocates who charge that recent demands for censorship coddle students and threaten free inquiry. In this clear and carefully reasoned book, a university chancellor and a law school dean—both constitutional scholars who teach a course in free speech to undergraduates—argue that campuses must provide supportive learning environments for an increasingly diverse student body but can never restrict the expression of ideas. This book provides the background necessary to understanding the importance of free speech on campus and offers clear prescriptions for what colleges can and can’t do when dealing with free speech controversies.

Book The Portable Chaucer

Download or read book The Portable Chaucer written by Geoffrey Chaucer and published by Penguin. This book was released on 1977-05-26 with total page 645 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the fourteenth century Geoffrey Chaucer, who served three kings as a customs official and special envoy, virtually invented English poetry. He did so by wedding the language of common speech to metrical verse, creating a medium that could accommodate tales of courtly romance, bawdy fabliaux, astute psychological portraiture, dramatic monologues, moral allegories, and its author’s astonishing learning in fields from philosophy to medicine and astrology. Chaucer’s accomplishment is unequalled by any poet before Shakespeare and—in The Canterbury Tales and Troilus and Cressida—ranks with that of the great English novelists. Both The Canterbury Tales and Troilus and Cressida are presented complete in this anthology, in fresh modern translations by Theodore Morrison that convey both the gravity and gaiety of the Middle English originals. The Portable Chaucer also contains selections from The Book of Duchess, The House of Fame, The Bird's Parliament, and The Legend of Good Women, together with short poems. Morrison's introduction is vital for its insights into Chaucer as man and artist, and as a product of the Middle Ages whose shrewdness, humor, and compassion have a wonderfully contemporary ring.
