Hayek et Richard Posner. C'est plus particulièrement une histoire analytique et méthodologique qui est proposée ici. Au-delà des lectures traditionnelles qui voient alternativement dans l'utilitarisme, le libéralisme ou l'instrumentalisme, le fondement de l'économie du droit, l'ouvrage montre que l'analyse économique du droit est le fruit d'un double mouvement: le tournant herméneutique en théorie du droit, qui insiste sur la texture ouverte des règles et l'importance de leur interprétation, et le tournant cognitif en économie qui place au coeur de l'analyse la notion d'information, l'incertitude et le rôle informationnel des règles de conduite. Les différentes étapes de la constitution de l'économie du droit sont alors autant de tâtonnements à la recherche d'une convergence entre ces deux séries de considérations autour de la nature informationnelle de la règle de droit et des mécanismes cognitifs par lesquels les règles sont interprétées par les autorités publiques et anticipées par les individus. C'est pourquoi le pluralisme contemporain en économie du droit, qui s'oppose souvent à l'école de Chicago, doit alors être moins lu en rupture qu'en continuité avec cette articulation fondamentale.
