Book excerpt: Les notions de dignité humaine, de respect , voire de principe, sont à la mode, mais leur conceptualisation ne paraît pas toujours assurée en droit. Ayant adopté pour voie de recherche la CEDH, le premier constat qui s'impose est l'absence du principe de l'écrit de la convention et la quasi absence de sa jurisprudence. Il convient donc d'élargir la recherche afin de démontrer la juridicité du principe mettant en oeuvre la convention, les organes chargés de son contrôle bénéficient en effet de multiples apports, matériels s'agissant des droits nationaux, formels s'agissant du droit international général. Le principe sera juridique si l'on parvient à répondre à la question de ses sources et à celle de son utilité du point de vue des sources, les apports matériels de l'histoire de la pensée se révèlent exceptionnels justifiant en particulier sa double dimension. Sa mise en oeuvre dans les ordres juridiques internes des états parties à la CEDH participe à l'enrichissement du contenu du principe et à son élaboration positive au niveau international. Car si le droit international écrit ne parvient pas à fonder la positivité du principe, la théorie des principes généraux de droit semble y parvenir. S'agissant de l'utilité, la recherche se révèle très riche. Le principe a une fonction interprétative déterminante. Expression du but de la CEDH, il constitue un principe matériel d'interprétation qui fonde une interprétation concrète et téléologique exceptionnelle de ce texte. Mais, la mise en oeuvre de ce principe ambivalent au cas d'espèce se révèle complexe, il convient de préciser ses différentes fonctions par l'examen concret des articles de la CEDH.

Mais, parce qu'ils touchent au quotidien, parfois à l'intime des juridictions nationales, ils peuvent susciter des tensions qu'une écoute réciproque, respectueuse des marges nationales pour atteindre des objectifs communs, doit permettre de surmonter. Cet ouvrage constitue pour les juristes comme pour les citoyens une voie d'accès commode pour comprendre les droits que la Convention leur garantit, pour en mesurer la portée et pour connaître les voies de recours qui leur sont offertes.

Its subject, reflected in the title "Sciences and Empires", is not a currently-accepted sub-discipline of the history of science; rather, it refers to a set of questions which found autonomy only recently. The terminology was strongly debated by the participants and, as is frequently suggested in this book, awaits fuller clarification.

Book excerpt: This volume consists of a carefully edited version of the General Course on Public International Law delivered at the Hague Academy of International Law to commemorate the fiftieth anniversary of the foundation of the United Nations. The author brings to them not only his background of academic distinction, but his experience as a practitioner concerned with major international legal issues. The rule of law in international affairs is a question of perennial concern but it is of greater moment these days for a number of reasons. The active agenda of the Security Council and its relative solidarity creates a paradox. Its increased political power is a source of hope but the modalities of the exercise of power present problems of principle and of legal concern. Another area of concern is the International Court, which has had a successful record since the early eighties and provides one of the guarantees of the maintenance of legality. Recent successes of the Court include the effective resolution of the territorial dispute between Chad and Libya. The general level of compliance with its decisions by States is impressive. Yet its success is matched not by encouragement and enhancement of its facilities but by United Nations financial constraints which hinder its work and, ultimately, may threaten its independence in relation to the political organs of the United Nations.

This approach holds that all the facets of the Human Condition have equal objectivity and legitimacy. It completes the accepted medical outlook and points the way toward a new `medical humanism'.

"Silent cinema" may rarely have been silent, but the sheer diversity of sound(s) and sound/image relations characterizing the first 20 years of moving picture exhibition can still astonish us. Whether instrumental, vocal, or mechanical, sound ranged from the improvised to the pre-arranged (as in scripts, scores, and cue sheets). Part I brings together studies dealing with descriptive concepts. First examined is the notion of “accidens” in Latin grammar and its Greek counterparts. Other papers address questions with a strong echo in today’s linguistics: localism and its revival in recent semantics and syntax, the origin of the term “polysemy” and its adoption through Bréal, and the difficulties attending the description of prefabs, idioms and other “fixed expressions”. This first part also includes studies dealing with representations of linguistic phenomena, whether these concern the treatment of local varieties (so-called patois) in French research, or the import and epistemological function of spatial representations in descriptions of linguistic time. Or again, now taking the word “representation” literally, the visual display of grammatical relations, in the form of the first syntactic diagrams. Part II presents case studies which involve wider concerns, of a social nature: the “from below” approach to the history of Chinese Pidgin English underlines the social roles of speakers and the diversity of speech situations, while the scrutiny of Lhomond’s Latin and French textbooks demonstrates the interplay of pedagogical practice, cross-linguistic comparison and descriptive innovation. An overview of early descriptions of Central Australian languages reveals a whole spectrum of humanist to positivist and antihumanist stances during the colonial age. An overarching framework is also at play in the anthropological perspective championed by Meillet, whose socially and culturally oriented semantics is shown to live on in Benveniste. The volume ends with a paper on Trần Đức Thảo, whose work is an original synthesis between phenomenology and Marxist semiology, wielded against the “idealistic” doctrine of Saussure.
