Book excerpt: “Crime doesn’t exist in black and white, but is born out of a grey area that needs to be analysed through a gendered, intersectional perspective.” However, these days a common belief is called – there’s a shift in penal philosophy from deterrence to reformation with the enactment of ‘The Probation of Offenders Act, 1958,’ and the various amendments in CrPC. Still, large numbers of young, first-time and petty offenders continue to form the main bulk of overcrowding figures in the prison population of the country. Just by turning the pages of the newspaper with a distracted mind, suddenly the eyes tickle on a news... When a pregnant 26-year-old woman walked into Byculla Women’s Jail in 2013, accused of being a Naxalite, the other inmates cautioned her to be extremely careful and not draw the ire of the prison officials. She wouldn’t be given nutritious food and had to be lucky if they took her to a hospital before her water broke. Are our prison world still the laboratories of torture?

Book Challenges to Civil Rights Guarantees in India

Download or read book Challenges to Civil Rights Guarantees in India written by A.G. Noorani and published by Oxford University Press. This book was released on 2011-10-13 with total page 216 pages. Available in PDF, EPUB and Kindle. Book excerpt: The civil rights of Indian citizens are guaranteed both in the Indian Constitution and through the State's international commitments. Despite these guarantees, the civil rights framework encounters numerous challenges from the State—problematic counter-terrorism laws, continuation of the death penalty, misuse of arrest and preventive detention powers, lack of implementation, and impunity. Through nine incisive essays on both traditional and emerging issues, this volume examines the prevailing imbalance between individual rights and State power. Many laws designed to protect the State do little more than protect State power at the expense of her citizens, directly flouting the Constitution, international law, and democratic principles. The authors critically analyse most of these laws, examining their justifications, background debates, and evolution, along with how they violate constitutional and international law. Taking into account relevant and contemporary comparative case law and developments in international law, this book makes a strong case for bold legal reforms and suggests various measures for improvement.

Download or read book Contesting Justice in South Asia written by Deepak Mehta and published by SAGE Publishing India. This book was released on 2017-12-18 with total page 381 pages. Available in PDF, EPUB and Kindle. Book excerpt: A first of its kind, Contesting Justice in South Asia provides a series of case studies from South Asia that detail the quest for justice, the links that can be drawn from different countries in the region and the points of contact and divergences in the enunciation and practice of law. A second theme that runs through the book discusses the corrosive and affective power of violence in its ability to forge new solidary groups and communities. This is the first serious attempt by activists and scholars to think of South Asia as a region bound together through war and collective violence. It will be an invaluable read for postgraduate students and scholars of law and society, political philosophy, sociology and anthropology of violence, history and memory as well as political activists and government departments.

Book Its Always Possible Transforming One of the Largest Prisons in the World

Download or read book Its Always Possible Transforming One of the Largest Prisons in the World written by Kiran Bedi and published by Sterling Publishers Pvt. Ltd. This book was released on 2005-12-01 with total page 444 pages. Available in PDF, EPUB and Kindle. Book excerpt: Motivation, persistence and perseverance are the distinct traits of determined and dedicated individuals who can make things happen. It's always possible, even when the task is awesome -- transforming the mindset of human beings. Located in India's capital, New Delhi, Tihar is one of the largest prisons in the world. Within a prison complex of over 200 acres are housed over 9,700 inmates -- men, women, adolescents, children; Indians and foreigners. They comprise unconvicted alleged offenders, convicts and remandees. Tihar was a limping, languishing institution, condemned by the media, and its inmates were isolated from the community, exploited, used and abused, yet 'housed'. Dr Kiran Bedi was appointed Inspector General of Tihar Prison in 1993. She brought about fundamental changes, giving a human face to the administrative structure and creating an exemplary system covering every possible aspect of prison management. The whole objective was to collectively and individually manage the transition from a moribund system to a responsive and sensitive administration. Hence her efforts unfolded the process of reformation involving prison administration, prisoners and the community, toward one common goal -- Correction through a collective approach. Dr Bedi's account is enhanced by input from the prisoners themselves, expressing their feelings in letters and sketches, in petitions and poetry. This book is a graphic portrayal of an holistic process of conversion, a metamorphosis from criminality to humanity, achieved within a restrictive legal framework.
