The Mackenzie Valley Resource Management Act was proclaimed December 22, 1998. This Act implements obligations under land claim agreements and creates an integrated co-management regime for the conservation, development and utilization of land and water resources, for the protection of the environment from significant adverse impacts, and for the protection of the social, cultural and economic well-being of residents and communities in the Mackenzie Valley. The MVEIRB may amend or add to these Guidelines at any time subject to any regulations ... and necessary consultation. ... These Guidelines describe the environmental impact assessment (EIA) process in the MVRMA. These Guidelines apply to developments on land or water in the Mackenzie Valley. They contribute to the conservation, development and use of land and water resources for the optimum benefit of the residents of settlement areas, the Mackenzie Valley and Canada. These Guidelines are intended to provide practical information on the EIA process in the Mackenzie Valley. They are designed to ensure that any rules and procedures meet the principles of natural justice and fairness. ... Book excerpt: "The Mackenzie Delta and Tuktoyaktuk Peninsula, located along the southern margin of the Beaufort Sea, have been areas of oil and gas exploration for over 50 years. The discovery of natural gas at the Taglu field in 1971, followed by the Parsons Lake discovery in 1972 and the Niglintgak discovery in 1973, established the region as a potential major new natural gas source. In 1977, Mr. Justice Thomas R. Berger issued "The Report of the Mackenzie Valley Pipeline Inquiry" (the "Berger Report"). ... Mr. Justice Berger also recommended that Mackenzie Valley pipeline development be postponed for 10 years, to provide time to settle native claims and to establish new programs and institutions so local peoples had more control over their lands. ... There are now settled land claims .... Now, 35 years after the Berger Report, there is another opportunity for the North, presented by the Mackenzie Gas Project ("MGP" or "Project"). ... The MGP offers an opportunity for the Proponents, Aboriginal communities, other Northern parties and Canadians to participate in responsible, economic development in the North. ... The MGP is, undeniably, one of the largest endeavours ever proposed in the Canadian North. Consequently, the MGP has been the subject of one of the most rigorous and comprehensive environmental impact review processes in Canadian history - this Joint Review Panel [JRP] process. The JRP was created ... in order to conduct an environmental assessment ("EA") of the MGP. ... The JRP process has consisted of 116 hearing days in 26 different communities, almost 5,000 filed exhibits and almost 12,000 pages of hearing transcripts. This has provided ample opportunity for a full and informed discussion of the Project, in an open and inclusive process. The Proponents submit that the evidentiary record before the JRP demonstrates that the Proponents have a strong commitment and ability to develop the MGP in a socially, economically and environmentally responsible manner within Canada's northern environment. The Proponents have thoroughly considered the Project effects and are confident that with appropriate mitigation and follow-up measures (contained in more than 500 commitments), there will be no likely significant adverse environmental effects caused by the Project. Further, the Proponents have shown that there are substantial benefits arising from the MGP while providing for the preservation of the Northern culture and traditional pursuits. The MGP will make a net positive contribution to sustainability. Therefore, the Proponents ask that the JRP recommend that the Project be approved and proceed to the next stage of regulatory permitting and approvals"--ASTIS database.

Book excerpt: "Summary report of environmental assessment: The Mackenzie Valley Environmental Impact Review Board (Review Board) undertook an Environmental Assessment (EA) of Paramount Resources Limited's (Paramount) proposed Cameron Hills Extension project according to the Mackenzie Valley Resource Management Act (MVRMA). The developer, Paramount Resources Ltd., proposes to drill up to 48 new oil and gas wells and build associated tie-ins to the existing pipeline over the next 10 years on the Cameron Hills Significant Discovery License (SDL). The Cameron Hills are located near the communities of Enterprise and Kakisa, in the southern portion of the Northwest Territories south of Great Slave Lake. Associated development activities proposed by Paramount include access roads, cutlines, camp locations and river crossings. In addition to analyzing written evidence, the Review Board held a community meeting on February 17, 2004 in Kakisa as well as a public hearing in Hay River on February 18-19, 2004. A review of the evidence on the public record has convinced the Review Board that: -The Cameron Hills is an important traditional use area for local First Nations and Metis. Some of the commitments to mitigation measures regarding harvester compensation made by Paramount in a previous EA have yet to be fulfilled. -There is a need for air quality monitoring in the NWT emerging as a result of oil and gas development and an emerging need for enforceable air quality standards. -The cumulative effects of ongoing development in the Cameron Hills may result in adverse effects on the regional boreal caribou population. Having considered all the evidence on the public record, the Review Board has concluded that the potential impacts of the proposed development can be mitigated if the developer's commitments are adhered to and if the mitigation measures proposed in this report of EA are accepted. The Review Board therefore recommends, pursuant to section 128(b) ii of the MVRMA that the proposed development proceed to the regulatory phase for approval"--Page vi.

Kirk Lambrecht surveys the law of actual and asserted Aboriginal rights and historical and modern Treaty rights in Canada and discusses the national and international purposes of environmental assessment and regulatory review.
