Drawing on documentary and doctrinal legal analysis, this book investigates how, in the space of a single decade, Australian law makers set out to regulate one of the most difficult aspects of police: undercover investigation. In so doing, the Australian experience represents a paradigm model. And yet despite its success, it is a system of law and practice that has a dark side – a model of investigation to relies heavily on activities that are unlawful in the absence of authorisation. It is a model that is as much concerned with the surveillance and control of police as it is with suspected criminal conduct. The book aims to locate the Australian experience in comparative perspective with other major common law jurisdictions (the United Kingdom, Canada and New Zealand), with a view to contrast strengths, similarities and weaknesses of these models. It is argued that the Australian model, at the pragmatic level, offers a highly successful model for regulatory structure and practice, providing a significant model for successful regulation. At the same time, the model that has been introduced raises important questions about how and why the Australian experience evolved in the way that it did, and the implications this has for the relationship between citizen and state, the judiciary and the executive, and broader questions about the protections offered by rights discourse and jurisprudence. Book excerpt: In 1994 the School of Criminology, a part of the Department of Criminal Law, Criminal Procedure and Criminology in the Faculty of Law of the Katholieke Universiteit Leuven, celebrated the 25th anniversary of its study programme. To give added lustre to this landmark in its history, the Institute accepted the invitation from the International Society of Criminology to organise the 49th International Course of Criminology. The title of the course was: Changes in Society, Crime and Criminal Justice in Europe. A challenge for criminological education and research'. This course explored two themes, both of which are likely to be the focus of debate in criminal policy in the near future: crime and insecurity in the city, and international organised and corporate crime. The presentation and discussion of both themes followed two main approaches. Lectures and seminars focused on the analysis of the nature, the quantity and the development of the phenomena, and meetings were focused on the policy needed to gain control of these phenomena. Moreover, attention was paid to technical and ethical problems which show up at the moment that empirical research is carried out. This publication brings together the main part of the introductory lectures. Part one relates to the theme of crime and insecurity in the city; the second part contains the lectures on international organised and corporate crime. Together both parts present a good picture of what was explained and commented on during the Course, especially in relation to important European developments concerning crime, criminal justice and criminal policy. This book will become an important source of inspiration for both criminological educationand research.

These developments are not new, but many of them have been extended and intensified. The result? More and more people and populations are counted as "suspicious" and, at the same time, surveillance techniques become increasingly opaque and secretive. Lyon argues that in the aftermath of 9/11 there have been qualitative changes in the security climate: diverse databases containing personal information are being integrated; biometric identifiers, such as iris scans, are becoming more popular; consumer data are merged with those obtained for policing and intelligence, both nationally and across borders. This all contributes to the creation of ever-widening webs of surveillance. But these systems also sort people into categories for differential treatment, the most obvious case being that of racial profiling. This book assesses the consequences of these trends. Lyon argues that while extraordinary legal measures and high-tech systems are being adopted, promises made on their behalf - that terrorism can be prevented - are hard to justify. Furthermore, intensifying surveillance will have social consequences whose effects could be far-reaching: the undermining of social trust and of democratic participation.

Book excerpt: First published in 1998, this volume seeks to examine a range of policing techniques which are new, if not in their conception, then at least in their importance to the form of police enquiries in the late 20th century. Some of them are beginning to be discussed under categories of 'proactive' or 'covert' policing: others are termed 'technological' because they depend intimately on the development of the new information technologies. In much of Western Europe and North America the nature of police investigative methods is being transformed. At the centre of these developments are three main trends. First, there is the increasing use of covert intelligence-gathering techniques such as participating informers, police undercover operations and surveillance proactively targeted at ‘suspicious’ individuals or networks. Secondly, there is the development of increasingly sophisticated information gathering and processing technologies (DNA) and fingerprint data bases, general intelligence storage systems, computer analysis of open source data, the Internet). Lastly there is an extending exploitation of powers to compel private individuals and companies to provide the state with information about themselves and third parties (including the use of information originally supplied to the state for purposes other than criminal investigation). This book argues that in different ways these trends represent a new invasion of the private sphere by investigative methods and a new challenge for traditional mechanisms for rendering the state’s policing accountable such as the trial, the judge and the defence lawyer. Bringing together contributions from sociologists and lawyers in Western Europe and North America, it surveys these developments, considers the regulatory options for their control and their implications for legal principles of privacy and due process.
