Book excerpt: As Congress considers immigration reform and ways to address the unauthorized alien population, the issue of unauthorized employment is the focus of much discussion. The unauthorized alien working population, like the unauthorized alien population generally, has been growing steadily. There were an estimated 7.2 million unauthorized workers in the U.S. civilian labor force in March 2005. It is widely accepted that most unauthorized aliens enter and remain in the United States in order to work. Thus, eliminating employment opportunities for these aliens has been seen as an approach to curtailing unauthorized immigration. Provisions enacted by the Immigration Reform and Control Act (IRCA) of 1986, which are sometimes referred to as employer sanctions, made it unlawful for an employer to knowingly hire, recruit or refer for a fee, or continue to employ an alien who is not authorized to work. It also established a paper-based employment eligibility verification system, known as the I-9 system, which requires that employers examine documents presented by new hires to verify identity and work eligibility, and complete and retain I-9 verification forms. There is general agreement that the I-9 process has been undermined by fraud. Employers violating prohibitions on unauthorized employment in the Immigration and Nationality Act (INA) may be subject to civil or criminal penalties. The Department of Homeland Security's Immigration and Customs Enforcement (DHS/ICE) is responsible for enforcing the INA prohibitions on unauthorized employment. Building on the employment verification system established by IRCA, the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (IIRIRA) directed the Attorney General to conduct three pilot programs for employment eligibility confirmation that were to be largely voluntary. Under the Basic Pilot program, the only one of the three pilots still in operation, participating employers verify new hires' employment eligibility by accessing Social Security Administration (SSA) and, if applicable, DHS databases. A variety of options has been put forth to curtail unauthorized employment and related practices, a selection of which is discussed in this report. Some of these options would build on the current employment eligibility verification system; these include making electronic verification mandatory, increasing existing penalties, or increasing resources for worksite enforcement. Others represent new approaches to address unauthorized employment, such as shifting responsibility for employment eligibility verification from employers to the federal government. This report will be updated if developments warrant.

[...] Based on data from the Current Population Survey (CPS) and other sources, the Pew Hispanic Center has estimated that the unauthorized resident population in the United States totaled 12.4 million in March 2007 and 11.9 million in March 2008.3 Estimates by the Department of Homeland Security (DHS) of the unauthorized alien population are somewhat lower. [...] INA §274B also provided for the establishment of the Office of Special Counsel for Immigration-Related Unfair Employment Practices (OSC) in the U. S. Department of Justice to enforce these provisions.10 Under INA §274B, employers found to have engaged in an unfair immigration-related employment practice shall be required to cease and desist from such practice and may be subject to other requiremen.

The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. Book excerpt: The U.S. Department of Homeland Security (DHS) is responsible for securing and managing the nation's borders. Over the past decade, DHS has dramatically stepped up its enforcement efforts at the U.S.-Mexico border, increasing the number of U.S. Border patrol (USBP) agents, expanding the deployment of technological assets, and implementing a variety of "consequence programs" intended to deter illegal immigration. During this same period, there has also been a sharp decline in the number of unauthorized migrants apprehended at the border. Trends in total apprehensions do not, however, by themselves speak to the effectiveness of DHS's investments in immigration enforcement. In particular, to evaluate whether heightened enforcement efforts have contributed to reducing the flow of undocumented migrants, it is critical to estimate the number of border-crossing attempts during the same period for which apprehensions data are available. With these issues in mind, DHS charged the National Research Council (NRC) with providing guidance on the use of surveys and other methodologies to estimate the number of unauthorized crossings at the U.S.-Mexico border, preferably by geographic region and on a quarterly basis. Options for Estimating Illegal Entries at the U.S.-Mexico Border focuses on Mexican migrants since Mexican nationals account for the vast majority (around 90 percent) of attempted unauthorized border crossings across the U.S.-Mexico border.

Book excerpt: An investigation was made of the Immigration Reform and Control Act (IRCA) of 1986, which requires employers to verify employment eligibility of workers and imposes civil and criminal penalties against employers who knowingly hire unauthorized workers. The study reviewed federal agency implementation of irca, reviewed discrimination complaints filed with federal agencies and data from groups representing aliens, and used additional methods to obtain data on IRCA's effects. The other methods included a statistically valid survey of more than 9,400 employers and a hiring audit in which pairs of persons (one a "foreign-sounding, foreign-appearing" Hispanic and one an Anglo with no foreign accent) who matched closely on job qualifications applied for jobs with 360 employers in 2 cities. The study found that the IRCA: (1) has apparently reduced illegal immigration and is not an unnecessary burden on employers; (2) has generally been carried out satisfactorily by the Immigration and Naturalization Service and the Department of Labor; and (3) has not been used as a vehicle to launch frivolous complaints against employers. The study also found that widespread discrimination was a result of the irca: many employers discriminated because the law's verification system does not provide a simple or reliable method to verify job applicants' eligibility to work. The discrimination would be reduced if employers were provided with more education on the law's requirements and a simpler, more reliable verification system.
