But what if, on the contrary, these were the signs of the deconsolidation of democracy instead of its good health? What if democratically elected regimes were to ignore constitutional principles representing the rule of law and the limits of their power? With contributions from judges and scholars from different backgrounds and nationalities this book explores the framework in which this tension currently takes place in several Western countries by focusing on four key themes: - The Rule of Law: presenting a historical and theoretical reconstruction of the evolution of the Rule of Law; - The People: dealing with a set of problems around the notion of 'people' and the forces claiming to represent their voice; - Democracy and its enemies: tackling a variety of phenomena impacting on the traditional democratic balance of powers and institutional order; - Elected and Non-Elected: focusing on the juxtaposition between judges (and, more generally, non-representative bodies) and the people's representation.

In the last two decades, European democracies have come under strain amid growing populism. By asserting the superiority of the majority over the law, of direct democracy over representation, and claiming the necessity to defend national sovereignty against foreign interferences, the populist conception of democracy is in stark contrast with the longstanding Western notion of liberal democracy. This volume investigates populist attempts to radically change what Bobbio called the “rules of the game” of democracy from an eminently legal perspective. Weaving together normative and empirical analysis, the contributions focus on the institutions that have suffered the most from the rise of populism as well as those that have better resisted the populist tide. Special attention will be paid to the Venice Commission’s opinions and documents, as they represent the best European standards to evaluate the extent to which populism deviates from constitutional democracy requirements. The book also considers the responses of European States to the explosion of the COVID-19 pandemic. The COVID-19 pandemic has indeed been an accelerator of known and studied trends in most constitutional systems, such as the concentration of powers in the executive hands and the consequential loss of parliament's centrality. Various forms of populism across Europe have thus found an ideal breeding ground to implement their agenda of granting the executive broad regulatory and decision-making powers while loosening parliamentary and judicial checks. Against this backdrop, the book analyses how European democracies should adapt to the challenges posed by the pandemic, as this reflection can help respond to populist threats and propose a way forward for liberal democracy.

Many democracy indices are reporting a year-on-year drift towards less liberal politics in the countries of the European Union. Polls regularly suggest that the voters are coming to question democratic norms more seriously than for many decades. Here, Richard Youngs assesses these risks as many analysts, journalists and politicians stressed the danger of Europe descending into an era of conflict, driven by xenophobic nationalism and nativist authoritarians slowly dismantling liberal democratic rights. In 2020, the Covid-19 pandemic has intensified these fears. There is another side of the democratic equation, however. Youngs argues that governments, EU institutions, political parties, citizens and civil society organisations have gradually begun to push back in defence of democracy. With each chapter, Youngs shows how many governmental, political and social actors have developed responses to Europe's democratic malaise at multiple levels. Europe's democracy problems have been grave and far-reaching. Yet, a spirit of democratic resistance has slowly taken shape. Following an introduction that defines the problem at the centre of the book and explains how legal theory can be used to address it, the book consists of eleven contributions divided into three thematic sections. The first covers topics concerning the European principles which can help avoid ethnic conflicts: the principle of compulsory adjudication in interstate relations, the principle of democracy, and principles regarding the recognition of individual and collective identities. These European principles are then investigated by drawing on legal and political theories. The second section presents three ways of conceptualizing ethnical needs in multi-ethnic states: asymmetric federalism, dêmoicratic account and cooperative federalism. The third and final section elaborates on issues concerning the protection of minority rights: the role of judicial ideology in protecting minority rights, citizenship, the EU mechanism for the protection of minority rights, and the importance of remembering tragic events affecting minorities.

The first and fundamental objective of the book is to provide an explanatory framework to understand phenomena related to violent radicalization, deradicalization, the prevention of radicalization and to political violence; in particular, that inspired by religion. The second objective follows from the first. Understanding violent radicalization of religious inspiration implies delving into two key concepts: violent radicalization and religion. This second objective is indeed elusive, since, on the one hand, many liberal democracies have undergone processes of secularization or, at least, have lost interest in examining religion in public debates. Therefore, rigorously exploring social problems where religion seems to be involved, in one way or another, is complicated. Moreover, the notion of violent radicalization, in turn, is highly contested and confused with other ideas, such as polarization, extremism, terrorism or nonviolent radicalization. Finally, the book aims to bring theory into dialogue with empirical phenomena, and to test it against concrete cases related to violent radicalization and its prevention, on the one hand, and religion, on the other. The book’s originality comes from both its innovative, methodological approach and its breadth, with cases from several countries (Spain, the United States, Ireland, India, Israel, Russia and Colombia) and different ideological groups (revolutionary communists, nationalist movements, Jihadist groups, white and black supremacists). Book excerpt: This Element discusses the consequences on the social bond of the conjoint action of the economic and social model inspired by the premises of neoliberalism and of the powerful pressures for the democratization of social relations in Chilean society. It is based upon empirical research developed in the past fifteen years. The main argument in this Element is that these processes have had as one of its most important effects the generation of a circuit of detachment, that is, a process that leads to different forms of disidentification and distancing from logics and principles that govern social relations and interaction. It is a dynamic circuit consisting of four components: excess, disenchantment, irritation, and, finally, detachment. The Element analyzes this circuit and each of its components as well as its consequences for the social bond. It also includes a brief reflection on the impact of this circuit over the political bond.
