Book excerpt: Este libro trata de dar una visión de conjunto, hoy muy descuidada por la doctrina, del amplio campo de materias que abarca el Derecho constitucional general. El enfoque fundamental de la obra es pues el de Teoría de la Constitución, utilizando con bastante frecuencia, sobre todo en algunos capítulos, el método comparado; en otros, en cambio, hay un estudio más eminente del Derecho constitucional español, al que se dedica en particular la última parte de la obra. No es tarea fácil resumir en pocas palabras cuestiones de extraordinaria complejidad que han sido analizadas y debatidas por pensadores, filósofos y juristas, en algunos casos durante siglos. Conceptos como el de Estado, soberanía, poder constituyente, democracia o sistema parlamentario han sido estudiados por centenares de especialistas y resulta muy complicado dar de forma sintética una visión general, siquiera sea de las principales aportaciones, que permita hacerse una idea global del tema y a la vez conocer las principales opiniones divergentes sobre cada uno de ellos, pero al menos esto es lo que ha intentado el autor en la exposición de la mayoría de las cuestiones tratadas en este libro. Tratándose de materias tan vastas y complejas procedentes de campos científicos diversos, como la Política, la Historia, la Filosofía y el Derecho, se ha procurado un estilo sintético y didáctico. No se entra en polémicas, pero se procura exponer la problemática principal y las posturas más destacadas en cada materia tratada. Incluso cuando el autor discrepa o propone soluciones de algún modo originales se evita la explicación exhaustiva y la crítica de argumentos ajenos que harían desmesurada esta obra de conjunto. Por ello el texto se halla dividido en letra grande, letra pequeña y notas explicativas, (además de las notas meramente bibliográficas). La letra pequeña es, en la mayor parte de los casos, de imprescindible lectura para la completa comprensión de la obra. En cambio, las notas explicativas sirven para aclarar o completar algún punto marginal y por tanto normalmente no es preciso leerlas para seguir el hilo de la exposición, sino sólo para una profundización en cuestiones concretas. Siguiendo una antigua tradición de la literatura jurídica, el libro se encuentra dividido en parágrafos ({606}) que remiten a otros lugares de la obra donde un asunto determinado se trata con más profundidad. No se incluye, sin embargo, una bibliografía recomendada porque ésta se va citando a pie de página al hilo de cada tema tratado. La primera parte está dedicada al Derecho constitucional y a sus fuentes. Se dedican los dos primeros capítulos a tratar de clarificar la naturaleza y el método del Derecho constitucional para dejar bien sentadas unas bases que, aunque inevitablemente polémicas, son imprescindibles para una construcción verdaderamente coherente y por tanto científica de cualquier disciplina jurídica, política o en general cultural. En el capítulo tercero se expone la teoría de las fuentes del Derecho aplicada al Derecho constitucional, con especial mención al caso español. Es cierto que la recta comprensión de la teoría de las fuentes parece aconsejar el conocimiento previo del concepto de constitución (capítulo 7) y a su vez éste el de Estado (capítulos 4 y 5), pero se ha respetado la estructura tradicional en la exposición completa de cualquier rama del Derecho, que comienza siempre por concepto y fuentes de la misma antes de entrar en otras consideraciones. La segunda y tercera parte constituyen, respectivamente, una breve síntesis de una tradicional Teoría del Estado moderno, incluyendo un capítulo sobre las doctrinas políticas, y de la Teoría de la Constitución, completada con una exposición de las formas políticas. La cuarta parte es una introducción a la organización política del Estado desde la óptica del Derecho comparado y la quinta una teoría constitucional de los derechos fundamentales, con incursiones en la historia y en la fundamentación de los derechos humanos. Conforme a la mencionada finalidad, ni se entra en la exposición de cada uno de los derechos en particular, ni se estudia su concreción en el Derecho positivo. Por último, la sexta parte de la obra es un análisis crítico de carácter introductorio al Derecho constitucional particular de España, tanto en su vertiente histórica como vigente. De este modo, el último capítulo se refiere a la Constitución de 1978, sus características y sus principios fundamentales, en el que se aplican al caso español los conocimientos teóricos anteriormente expuestos.
