The United States devoted greater attention to Ukraine than any other post-Soviet state (except Russia) after the breakup of the Soviet Union. Steven Pifer, a career Foreign Service officer, worked on U.S.-Ukraine relations at the State Department and the White House during that period and also served as ambassador to Ukraine. With this volume he has written the definitive narrative of the ups and downs in the relationship between Washington and newly independent Ukraine. The relationship between the two countries moved from heady days in the mid- 1990s, when they declared a strategic partnership, to troubled times after 2002. During the period covered by the book, the United States generally succeeded in its major goals in Ukraine, notably the safe transfer of nearly 2,000 strategic nuclear weapons left there after the Soviet collapse. Washington also provided robust support for Ukraine’s effort to develop into a modern, democratic, market-oriented state. But these efforts aimed at reforming the state proved only modestly successful, leaving a nation that was not resilient enough to stand up to Russian aggression in Crimea in 2014. The author reflects on what worked and what did not work in the various U.S. approaches toward Ukraine. He also offers a practitioner’s recommendations for current U.S. policies in the context of ongoing uncertainty about the political stability of Ukraine and Russia’s long-term intentions toward its smaller but important neighbor.

However, the allocation of rights and duties of the coastal state and third states is open to interpretation. Recent developments in state practice, such as Australia's requirement of compulsory pilotage in the Torres Strait, the bridge across the Great Belt and the proposals for a bridge across the Strait of Messina, the enhanced environmental standards applicable in the Strait of Bonifacio and Canada's claims over the Arctic Route, make it necessary to reassess the whole common law of straits. Book excerpt: The issue of historic rights and historic waters has long been a problematic area in the law of the sea where even basic definitions have been vague and interchangeably used in the past. The first edition of this book was entitled Historic Waters in the Law of the Sea: A Modern Re-Appraisal, and concentrated, as the title implies, on the doctrine of historic waters. The title of this expanded new edition has been broadened to take account of the important clarifications as to the doctrine of historic maritime claims generally—particularly 'historic rights' in the narrow sense which fall short of sovereignty claims. These latter rights—such as they now are—are discussed in depth in the new text. This development has come about, of course, because of the Award of the Arbitral Tribunal in Philippines v. China in 2016. This decision has, for the first time in a judicial setting, rationalised the terminology in this area of the law of the sea; and, most importantly, has clarified the close interaction of historic rights with the Law of the Sea Convention. This new edition discusses the latter issue passim, showing that much of the former customary law doctrine has now been overridden by the Convention.

Book excerpt: The four 1958 Geneva Conventions on the Law of the Sea, which codi?ed and progressively developed this sector of our legislation, were rather ephemeral despite the fact that they were constituent Conventions. In fact, the 1982 United Nations Convention on the Law of the Sea (UNCLOS) again undertook the same task with the same spirit 20 years later after a long drawn out global negotiation process in which all the marine areas and problems pending were analysed and discussed by the countries attending, and an apparently strengthened majority was attained, including the essential agreement between the principal naval powers and the third world countries, symbolised most grossly in the recognition of exclusive economic areas which were 200 miles wide in exchange for a signi?cant alteration to the legal rules applicable to the international straits. From 1973 to 1982, the negotiations showed that there were a number of particular factors affecting the seas: “strait” countries, user countries, long range ?shing countries, embedded countries, archipelagic countries, broad platform countries, etc. In 1982 when the UNCLOS was adopted, it seemed to be a text with justi?ed pretensions to be in force for a long period of time as the nine years of negotiations required for its adoption had taken into account the main problems pending agreement although not absolutely all.
