Book Battling Terrorism

Download or read book Battling Terrorism written by Jackson Nyamuya Maogoto and published by Routledge. This book was released on 2016-04-15 with total page 364 pages. Available in PDF, EPUB and Kindle. Book excerpt: The attacks of September 11, 2001, the US response and the international community's approval of the subsequent military action represent a new paradigm in the international law relating to the use of force. Previously, acts of terrorism were seen as criminal acts carried out by private, non-governmental entities. In contrast, the September 11 attacks were regarded as an act of war which marked a turning point in international relations and law. This exceptional and timely volume examines the use of force in the war against terror. The work is based on the central theme that the use of force is visibly enrolled in a process of change and it evaluates this within the framework of the uncertainty and indeterminacy of the UN Charter regime. The status of pre-emptive self-defence in international law and how it applies to US policy towards rogue states is examined along with the use of military force, including regime change, as an acceptable trend in the fight against state-sponsored terrorism.

Book The Lockerbie Trial

Download or read book The Lockerbie Trial written by P. A. van Laar and published by International Courts Association. This book was released on 2011 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: No aircraft disaster in history has produced the amount of legal wrangling as the bombing of Pan Am Flight 103 over Lockerbie, Scotland, on December 21, 1988, in which 259 passengers and crew members and 11 people on the ground were killed. The Lockerbie families wanted justice in the name of their relatives that died in the aircraft, but only in 1996 did the US Administration and Congress amend the Foreign Sovereign Immunities Act with the Anti-Terrorism and Effective Death Penalty Act that allowed civil actions against Libya. Libya was finally served, under the provisions of the Act, in 1997, and answered the complaints, asserting in its answers that the underlying statute was unconstitutional. One area of the Lockerbie litigation was the unusual use by Libya of an international treaty called The Montreal Convention of 1971 for the Suppression of Unlawful Acts against the Safety of Civil Aviation. The purpose of this treaty was to prevent attacks against civil aircraft and provide for cooperation between countries when there has been such an attack and to provide appropriate measures to punish offenders. It was not meant to give jurisdiction over criminal proceedings to the country of the alleged wrongdoer. This book contains legal materials related to the Lockerbie Trial and examines this landmark case in international criminal law. (Series: International Courts and Tribunals Cases - Vol. 4)

Book The Terrorist Trap Second Edition

Download or read book The Terrorist Trap Second Edition written by Jeffrey D. Simon and published by Indiana University Press. This book was released on 2001-12-07 with total page 500 pages. Available in PDF, EPUB and Kindle. Book excerpt: The bombings of the Murrah Federal Building in Oklahoma City and of the World Trade Center in New York City have joined a long history of terrorists acts against the United States. In this newly updated edition of his book, Jeffrey Simon reaches back to the founding days of the Republic to tell a story that is both instructive and alarming. Simon uncovers the dynamics of a deadly conflict that affects all Americans. His in-depth interviews with terrorists and their victims, with reporters, government officials, and others bring to life a tale of presidents and terrorists, media and society, all entangled in a drama of international violence. The Terrorist Trap traces the government response to terrorism from the days of Thomas Jefferson and the Barbary Pirates to William Jefferson Clinton's confrontation with homegrown terrorism. It explores the terrorist trap: the psychological, political, and social elements that make terrorism unlike any other conflict. With the end of the Cold War and the defeat of Saddam Hussein's army in the Gulf War, many believed that the threat of terrorism had been significantly reduced. But Simon shows how terrorism grows out of political, economic, and social grievances that can never be fully resolved, as events in Israel and elsewhere continue to demonstrate. Living with terrorism will be an inescapable part of life in the twenty-first century. Simon calls on officials to move away from the useless rhetoric of defeating terrorism and to focus instead on achievable goals in combating this global problem.
