Book excerpt: The effectiveness of U.S. Government controls over commercial munitions exports and the accuracy of export data being reported to Congress were reviewed. The U.S. munitions export control system cannot be depended upon to ensure that munitions are not exported without a license or that shipments made under license conform to the license terms. Responsibility for export controls is divided between the Commerce Department, the State Department's Office of Munitions Control (OMC), and the U.S. Customs Service. Coordination between the three agencies is not sufficient to ensure compliance by munitions exporters. Controls over munitions exports are further weakened by errors the Customs Service makes in controlling export licenses and validating shipper's export declarations. The errors by Customs and deficiencies in OMC data processing procedures have caused inaccuracies in the reports on munitions exports that are made to Congress.

This report assesses how gov't. departments assist co's. in determining the proper controls for defense-related items, specifically: (1) how Commerce implements the commodity classification process; & (2) how State implements the commodity jurisdiction process.

Specifically, defense industry officials have stated that extended reviews of export license applications by the State Department are resulting in lost sales and are adversely affecting the nation's defense industry. In the United States, the State Department's Office of Defense Trade Controls is the office responsible for licensing the export and temporary import of defense articles and services. In June 2001, we reported to you that the State Department completed over 46,000 license application reviews in fiscal year 2000. While the U.S. export licensing process can be lengthy because of foreign policy and national security considerations, other factors may also have an impact on processing times. Therefore, you asked us to determine whether elements of the process create delays in license application reviews.

Book excerpt: The U.S. government has long been concerned about the growing threat to U.S. interests from the proliferation of missiles, their components, and related technologies. These missiles can deliver chemical, biological, and nuclear weapons of mass destruction. In an effort to address these concerns, the United States has committed to work with other countries through the Missile Technology Control Regime to control the export of missile-related items. With the passage of the National Defense Authorization Act for Fiscal Year 1991, the Congress amended existing export control statutes to strengthen missile-related export controls, consistent with the U.S. government's commitments to the Regime. Under the amended statutes, the Departments of Commerce and State share primary responsibility for controlling exports of Regime items. The Commerce Department is required to control Regime items that are dual-use (those having both military and civilian uses) on its export control list the Commerce Control List. All other Regime items are to be controlled by the State Department on its export control list the U.S. Munitions List.
