The GAO wants to support Congress, while at the same time doing right by the citizens of the United States. Book excerpt: The complexity, breadth, and ongoing nature of many of the problems with China's WTO compliance demonstrate the need for a cohesive and sustained effort from the key U.S. agencies to effectively monitor and enforce China's implementation of its commitments. The U.S. Trade Representative (USTR), and the Departments of Commerce, State, and Agriculture (USDA) have coordinated on policy issues and increased staff resources to enhance their capacity to carry out these efforts. However, there are three areas in which we noted that these key agencies should take steps to improve their efforts and maximize the effectiveness of the resources allocated to the task of securing the benefits of China's membership in the WTO. First, although U.S. government efforts to ensure China's compliance emphasize high-level bilateral engagement, we recommended that USTR take steps to maximize the potential benefits of the WTO's annual multilateral review of China's compliance, referred to as the Transitional Review Mechanism (TRM). Second, to more effectively plan and measure results, we recommended that each of the key agencies improve performance management of their China-WTO compliance efforts. Third, we recommended that, in an environment of high and regular staff turnover, the key agencies should direct additional management attention to ensuring that staff have an opportunity to acquire training relevant to their China-WTO compliance responsibilities.

Book excerpt: Some U.S. companies allege that unfair subsidies are a factor in Chinese success in U.S. markets. U.S. producers injured by subsidized imports may normally seek countervailing duties (CVD) to offset subsidies, but the U.S. does not apply CVDs against countries, including China, that the Dept. of Commerce classifies as non-market economiesÓ (NME). This report: (1) explains why the U.S. does not apply CVDs to China; (2) describes alternatives for changing this policy; (3) explores challenges that would arise in applying CVDs; & (4) examines the implications for duty rates on Chinese products. Includes recommendations. Charts & tables.

Total U.S.-China trade rose from $5 billion in 1980 to $181 billion in 2003. China is now the third largest U.S. trading partner, its second largest source of imports, and its sixth largest export market. With a huge population and a rapidly expanding economy, China is becoming a large market for U.S. exporters. Yet, U.S.- China commercial relations have been strained by a number of issues, including a surging U.S. trade deficit with China ($124 billion in 2003), China's restrictive trade barriers, failure to provide adequate protection for U.S. intellectual property rights (IPR), and its refusal to float its currency. After 15 years of negotiations, China joined the World Trade Organization (WTO) on December 11, 2001. China's entry into the WTO requires it to significantly reform its trade regime by eliminating or reducing an extensive array of tariff and non-tariff barriers on goods, services, and foreign investment. The removal of these barriers could result in significant new opportunities for U.S. exporters. Many Members of Congress have called on the Bush Administration to closely monitor China's compliance with its WTO commitments. In December 2003, the U.S. Trade Representative (USTR) ...
