Book Environmental Law for the Construction Industry

Download or read book Environmental Law for the Construction Industry written by Amanda Stubbs and published by Thomas Telford. This book was released on 2002 with total page 184 pages. Available in PDF, EPUB and Kindle. Book excerpt: Environmental Law for the Construction Industry is an introduction to the wide subject of environmental law as it affects the construction industry. Changes in the structure of contracting arrangements have meant that those traditionally concerned with the construction process must now take greater interest in environmental law. In addition there is now a mass of regulation, governing matters such as waste management, water pollution, noise and other nuisances that have to be adhered to in practice. Readers will be provided with a broad outline of the legal and regulatory framework and a summary of the principle duties, which result from the legal regime. This essential book offers the ability to understand the requirements that the law imposes and, in individual cases, whether they face a problem with which they should be concerned. In addition, the book offers some thoughts on insurance and financing considerations, and some suggestions on managing an environmental crisis, including dealing with regulatory inspectors and protest actions. To reflect the changes and developments in the law, this new edition has been modified and supplemented in a number of areas to increase the clarity of its exposition and to add further useful information. All chapters previously covered have been fully revised and updated, with a new chapter 9, which examines crisis management in the context of environmental matters such as pollution events and protest actions. Environmental Law for the Construction Industry: 2nd Edition provides a quick reference manual with a user-friendly summary intended to simplify some of the complexity and confusion that surrounds this area of law. Environmental Law for the Construction Industry: 2nd Edition is aimed primarily at contractors, although it will clearly be relevant to all those within the construction industry who have some level of responsibility for, or interest in, environmental issues.

Download or read book Hazardous Decisions written by D. Huitema and published by Springer Science & Business Media. This book was released on 2005-12-15 with total page 515 pages. Available in PDF, EPUB and Kindle. Book excerpt: where Jeremy Richardson, Albert Weale and Hugh Ward were excellent hosts at the Department of Government and Thomas Christiansen a very good roommate. Having included the UK as a country where decision processes were far less participatory (and thus ‘worse’ in my own view) than those in the Netherlands, I started doing my first interviews there, which were mainly intended to identify suitable case studies for research. But then I read a highly critical review of a book that had a similar topic as my study. The critique was that cases of hazardous waste siting cannot adequately be studied without understanding their national context. This made me decide to devote some attention to the legal context of hazardous waste siting in the three countries of interest (which is of course only a part of the national context) and its development through the years. The study of the UK system of environmental regulation and land use planning was not a simple issue, and I was warned various times (for instance by Andrew Blowers at the Open University) that the legislation was highly complex and easily misinterpreted. I felt personally touched by such warnings and decided that I should perhaps approach the UK system a bit less as an evil empire and maybe be a bit more ‘objective’ in my appraisals.

Book Marine Pollution Shipping Waste and International Law

Download or read book Marine Pollution Shipping Waste and International Law written by Gabriela Argüello and published by Routledge. This book was released on 2019-07-22 with total page 322 pages. Available in PDF, EPUB and Kindle. Book excerpt: Waste management poses increasing challenges to both the protection of the environment and to human health. To face these challenges, this book claims that environmental law needs to shift attention from media-specific pollution regimes to integrative life-cycle approaches of waste management i.e., from the prevention of waste generation to the actual handling of wastes. Furthermore, the cooperation of States and the establishment of coordinated activities is essential because states can no longer have separate standards for wastes posing transboundary risks and for ‘purely domestic’ wastes. Drawing upon both International and EU law, the book provides a detailed analysis of the regimes set up to deal with the transboundary movement of wastes and ship-source pollution, so as to elucidate the obligations and legal principles governing such regimes. It concludes that treaty obligations concerning transboundary movements of wastes are inapplicable to ship wastes while on board ships and on land. However, despite the limitations of the transboundary movement of wastes regime, the principle of Environmentally Sound Management (ESM) embodied in this regime has gradually transformed into a legal principle. ESM works to address the legal gaps in the regulation of wastes, and consequently, it provides the desired coherence to the legal system since it acts as a bridge between several regulatory and sectoral levels. Furthermore, ESM offers a new light with which to understand and interpret existing obligations, and it provides a renewed impetus to regimes that directly and indirectly govern wastes. This impetus translates into greater coordination and the establishment of cross-sectional policies. By offering alternative ways to solve problems linked to the management of ship wastes in the sea-land interface, this book will appeal to anyone with an interest in International Environmental Law.

PFI has been controversial in the UK; despite some high-profile problems with specific projects, the National Audit...
