The murders of two British soldiers in Antrim, just after the report period, confirmed the finding that dissident republican movements - particularly Continuity IRA and the Real IRA - remain a major danger to peace, with a continuing high level of serious violent activity detailed in this report. All the groups are also involved in other ciminal activity such as drug dealing, kidnapping, extortion and smuggling and fuel laundering. The loyalist paramilitaries showed less activity, with the mainstream UDA now needing to address urgently the issue of decommissioning of weapons before the protection of the decommissioning legislation is lifted (by February 2010 at the latest).The UVF appears to be continuing to run down though some members are still involved in criminal activity for personal gain.

Of the republican groups, the Commission finds that âgliagh nâireann (ONH), Continuity Irish Republican Army (CIRA), Irish National Liberation Army (INLA) and the Real Irish Republican Army (RIRA) remain involved in serious crime and violence, and are still a threat. The Provisional Irish republican Army (PIRA), as reported in the Commission's last two reports, is committed to an exclusively political path. Of the loyalist groups, the Loyalist Volunteer Force (LVF) is involved in criminal activity with no political purpose; the Ulster Defence Association (UDA) is still a split organisation, with some members heavily involved in violent and serious crime, with no progress towards decommissioning of weapons; the breakaway South East Antrim Group of the UDA is now effectively a separate organisation and is pursuing a policy of community engagement, but involvement in serious crime is still evident; the Ulster Volunteer Force (UVF) and Red Hand Commando (RHC) continue to put weapons "beyond reach", to downsize the organisation, and to reduce the level of criminality on the part of members. The report also contains statistics on the incidence of violence.

Using the political and legal status of England, Scotland and Wales as a comparison, Jessie Blackbourn evaluates eight aspects of Northern Ireland which the Agreement aimed to normalise: the contested constitutional status of Northern Ireland, the devolution of power, decommissioning, the removal of emergency laws, demilitarisation, police reform, criminal justice reform, and paramilitary prisoners. The book highlights the historical context which gave rise to the need for a programme of normalisation within the Belfast Agreement with respect to these areas and assesses the extent to which that programme of normalisation has been successfully implemented. The monitoring is undertaken in the light of two considerations: an assessment of the paramilitary threat, and the British Government's obligation to ensure the safety and security of the community as a whole. The Commission believes the Provisional IRA is committed to the political path and has abandoned terrorism and violence. Dissident republican groups, however, continue to pose a threat to both the security forces and the community at large. Loyalist paramilitaries do not pose a threat, though the Commission notes that the UDA has made no progress in decommissioning weapons. The security normalisation is examined under several headings: the use of military in support of the Police Service of Northern Ireland; the repeal of counter-terrorist legislation particular to Northern Ireland; the police estate; and patterns of police patrolling. Of particular note is the fact that, for the second year running, the parades of 12 July were policed without the need for military assistance. Various annexes detail the closure of towers, observation posts, and military bases, and the monthly troop levels and military helicopter use in Northern Ireland over the two year period. Overall, the Commission finds that the requirements of the programme have been met.

But when it comes to the EU these dimensions are lacking. The present system for protecting fundamental rights emerged on an ad hoc basis, with measures being improvised to respond to particular problems. In the next couple of years, however, this situation is likely to change very significantly. The proposed European Constitution incorporates the EU Charter of Fundamental Rights, and a specialized EU Fundamental Rights Agency is likely to be established. As a result, the situation of the EU will more closely resemble that of its Member States. Fundamental rights will occupy a central role, and coherent and systematic arrangements will be in place to protect rights, using both judicial and non-judicial means. The Fundamental Rights Agency, in particular, has immense potential to ensure effective monitoring of fundamental rights in the EU, and to ensure a unified strategy for their promotion in EU law and policy. This volume is the first to critically examine the proposals put forward by the European Commission in October 2004 on the creation of the EU Fundamental Rights Agency. Leading scholars in the field of European and international human rights law analyse the potential significance of this innovative Agency, and seek to locate it in relation to various other human rights mechanisms, both in the EU's constitutional structure and within Member States. They review the tasks which the Agency could be called upon to perform, and make proposals as to how it can function most effectively. The relationship of EU law to the international law of human rights emerging from both the United Nations and the Council of Europe is examined. The authors also address the challenge of ensuring improved coherence between EU law and the other human rights obligations undertaken by the Member States. Taken together, these contributions address urgent questions facing the EU at a time when the central unifying function of fundamental rights has been recognized but the way forward remains largely uncharted.
