The Committee distils from its experience a number of suggestions for consideration by its successor committee and recommendations addressed to the Government, in order to enhance the integration of human rights considerations into the overall policy and legislative process. Chapter 2 explains the background to the Committee's establishment. Chapter 3 covers the legislative scrutiny performed by the Committee. The monitoring of the implementation of the Human Rights Act is the subject of chapter 4, while chapter 5 covers work in relation to institutional support for human rights within the UK. The inquiries into the international treaties to which the UK is a party are dealt with in chapter 6, including the Convention on the Rights of the Child, the International Covenant on Economic Social and Cultural Rights, and the Convention on the Elimination of Racial Discrimination. The final chapter describes the work undertaken on monitoring action taken by the Government in response to incompatibilities with Convention rights, arising from Strasbourg judgments and declarations of incompatibility by UK courts.

Book excerpt: The Major Projects Report 2003 provides information on progress made by the Ministry of Defence in procuring major defence equipment against cost, time and technical performance targets. It covers 30 projects split, according to Smart Acquisition principles, between the 20 largest projects on which the main investment decision has been taken, and the 10 largest projects yet to reach that point. For the 20 largest projects, costs are forecast to have increased by £3.1 billion in the last year, and are now 6.1 per cent over their approved costs. Difficulties on four older projects (which predate the introduction of Smart Acquisition) account for the majority of cost and time overruns. Following on from a NAO report on this topic (HCP 195, session 2003-04; ISBN 0102926581) published in January 2004, the Committee's report examines four main issues: the impact of the large cost overruns and delays; departmental risk management; ways of developing a more constructive relationship between the Department and industry; and lessons that need to be learned to avoid such poor procurement performance being repeated in future.

Book excerpt: The Joint Committee on Human Rights examined the implementation of the UN International Covenant on Economic, Social and Cultural Rights in the UK. Domestic legislation protects many of the economic, social and cultural rights, with the Covenant itself having little impact in UK domestic law. The Committee believes that there is scope for incorporating further protection of rights in the UK, by enshrining some of the guarantees contained in the Covenant. Further, that for the Covenant rights to be effective, they should be part of a framework for government policy development, and that Government along with the Commission for Equality and Human Rights should develop ways of measuring the progress of these rights. The Committee also recommends, that explanatory notes to Bills, should include discussion of the Bills compatibility with Covenant rights, which is a way of enhancing the scrutiny of proposed Government legislation. Furthermore, the Committee recommends the introduction of an Equality Bill, to address the concerns of discrimination faced by ethnic minorities and persons with disabilities in employment, housing and education.

Book excerpt: Although there has been a lot written about how counter-terrorism laws impact on human rights and civil liberties, most of this work has focussed on the most obvious or egregious kinds of human rights abrogation, such as extended detention, torture, and extraordinary rendition. Far less has been written about the complex ways in which Western governments have placed new and far-reaching limitations on freedom of speech in this context since 9/11. This book compares three liberal democracies - the United States, the United Kingdom and Australia, in particular showing the commonalities and similarities in what has occurred in each country, and the changes in the appropriate parameters of freedom of speech in the counter-terrorism context since 9/11, achieved both in policy change and the justification for that change. In all three countries much speech has been criminalized in ways that were considered anachronistic, or inappropriate, in comparable policy areas prior to 9/11. This is particularly interesting because other works have suggested that the United States' unique protection of freedom of speech in the First Amendment has prevented speech being limited in that country in ways that have been pursued in others. This book shows that this kind of argument misses the detail of the policy change that has occurred, and privileges a textual reading over a more comprehensive policy-based understanding of the changes that have occurred. The author argues that we are now living a new-normal for freedom of speech, within which restrictions on speech that once would have been considered aberrant, overreaching, and impermissible are now considered ordinary, necessary, and justified as long as they occur in the counter-terrorism context. This change is persistent, and it has far reaching implications for the future of this foundational freedom.

Book excerpt: The BBC's White City 2 property development in West London comprises three new buildings, which were built next to an existing BBC building known as White City 1. White City 2 was financed by Land Securities Trillium under a 30 year partnership deal with the BBC, which also covered property services at 48 other BBC locations. The cost of construction for White City 2 was £210 million, along with £60.9 million for furniture and technical fit-out of the buildings. The development was completed on time, but the Committee of Public Accounts found several aspects of the project constituting risks to value for money. The cost of the development also exceeded the amount originally approved by the BBC Governors, along with significant variations to the scheme as the project progressed. The Committee set out a number of conclusions and recommendations: that the whole life costs of projects should be assessed and made available to the BBC Governors; the BBC should better integrate design and construction, so reducing the risk of design changes after contracts have begun; the license fee money should not be used to subsidise the BBC's commercial subsidiaries, and that rent charged for the sublet of buildings should meet the BBC's costs; that the BBC should not hold on to property which it does not need or which it cannot use cost-effectively; the BBC in future should follow public sector good practice, in particular in estimating whole life costs of projects, monitoring returns to the private sector, obtaining refinancing benefits, and integrating design and construction.

Book excerpt: This report from the Committee of Public Accounts looks at the PFI deal struck between HM Customs and Excise and the Inland Revenue, in April 2001, when it transferred the ownership and management of most of their estates to Mapeley, a private sector consortium. The deal was to provide a reduction in costs, particularly in having the ability to vacate up to 60% of the estates, with residual lease costs being borne by Mapeley. The contract was won by Mapeley because it offered a cheaper bid, based on speculative returns from the increases in commercial property values over a 20-year time period, also it believed it would win other business contracts to increase profits. Once the PFI contract was signed the freehold and long-leasehold properties were transferred to a company based in Bermuda. Because of the implications for capital gains tax and a later request from Mapeley for additional money, The Committee makes a number of recommendations on how the contract could have been better handled by the Department.

Book excerpt: The 10 year NHS cancer plan, published in 2000 established 34 cancer networks in England, to lead to the improvement of cancer services in each locality. The National Audit Office investigated the plan's progress (HC 343, session 2004-05, ISBN 0102932379), and the Committee subsequently took evidence on three main issues: improving the provision of cancer services; making cancer networks work; and addressing inequalities. Increased funding is getting through to front line staff, and is being spent on new drugs, staffing and new services. But 30 per cent of the networks have no comprehensive plans for providing cancer services in their locality. Monitoring of performance against targets by the networks is inconsistent, and very necessary when faced with some demanding targets. Relationships between the networks and the primary care trust should be improved. Inequalities persist: cancer mortality rates are higher in areas of greatest deprivation, the highest mortality rates being twice the lowest across strategic health authorities. In addition, patients are diagnosed with cancer at a later stage in the UK than in other European countries, particularly in deprived areas. The networks should make clear how inequalities are to be addressed.
