Book excerpt: The canonical collections took their starting point from the ‘sacred law’ (ius sacrum) characteristic of canon law, since its norms promote the sanctification of the individual persons. This principle was the basis for the compilation of the so-called Pre-Gratian canon law collections, too. In the recent research, there have arisen new stresses on the better understanding of how this textual development of canonical collections had happened prior the Decretum Gratiani. An original canonical textual witness testifies about the circumstances of its origin, and, indeed, about the physical effects on the text during daily usage. The endeavor to issue the complete canon law did not mean only the composition of the universal canonical norms, but also the gathering of the particular norms, inveterate customs, or theological statements that could set the contents of the ecclesiastical discipline in the proper light.

The council’s status as an ecumenical council was questioned by its opponents and its decrees ignored, resisted, or only slowly implemented. This new collection of articles by Nelson H. Minnich examines: what is an ecumenical council, the reasons Lateran V qualifies as such, the roles the popes played in it, the council as a theater for demonstrating papal power, what was proposed as its agenda, what decrees were issued, and to what extent they were implemented. The decrees that receive special attention are those: affirming the legitimacy of the credit organizations known as montes pietatis that charged management fees, imposing prepublication censorship on printed works, abrogating the Pragmatic Sanction of Bourges (1438), reining in the privileges of mendicant friars, and closing the council while imposing a crusade tithe. These decrees were gradually implemented and Carlo Borromeo incorporated some of the Lateran reform decrees into his conciliar legislation that was taken up by other bishops. Lateran V did leave a lasting legacy and Leo X considered the council one of his great achievements. The volume includes four studies not previously published in English. (CS1060).

Active in the Roman Curia from the 1120s, a student in Paris, and associated with both Peter Abelard and Arnold of Brescia, he was made cardinal deacon of Santa Maria in Cosmedin in 1144 and served there during forty-seven years before being elected as pope in 1191. As curial cardinal and as papal legate in France, Spain, Portugal and the Empire, he was deeply involved in many of the major political conflicts and ecclesiastical reforms of his time. As pope, he contended with formidable secular rulers and serious setbacks for the crusading movement. His pontificate saw particularly notable developments in the fields of canon law and canonization policy, while his Roman origins influenced his artistic patronage in Rome and his attitude to the city's Jews.
