A partir das Declarações de Estocolmo (1972) e do Rio de Janeiro (1992) tivemos uma mudança conceitual na análise dos mecanismos de defesa da vida e da saúde dos trabalhadores, com a inserção do ambiente de trabalho no conjunto das preocupações dos ambientalistas. O direito ambiental não aceita a tarifação das lesões à saúde e caminha de acordo com princípios próprios, dentre os quais se destaca o princípio da prevenção e da precaução. Dentro do contexto dialético da globalização e de regionalização, o meio ambiente do trabalho torna-se objeto de preocupações no âmbito comunitário. Diante disto, busca-se aqui demonstrar a importância da experiência da União Européia e das Convenções da OIT sobre saúde e segurança no trabalho para a formação do direito comunitário do Mercosul.
