Book Fundamentals of Trust Accounting Income and Principal Rules Under the Revised New York State Laws

Download or read book Fundamentals of Trust Accounting Income and Principal Rules Under the Revised New York State Laws written by Seymour Goldberg and published by . This book was released on 2014 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: "In New York State alone there are well over 10,000 attorneys that are involved in trust drafting, tax planning, estate planning, trust accounting, trust litigation and elder law planning, but very few local bar associations in New York State have any material on this particular subject area ... until now. Many New York attorneys need a manual on the trust accounting income and principal rules from a practical application standpoint. This is especially true today because many attorneys draft trust documents. An attorney involved in drafting trusts in New York State has to be aware of the trust accounting rules that are applicable to a trust that is subject to New York State trust laws. This knowledge is especially important if he or she acts as trust counsel to the trust that he or she created. In addition, many trustees submit trust accountings to the trust beneficiaries. The failure of the attorney to know the trust accounting rules for the trust he or she created could result in headaches and liability issues for the attorney. Many practitioners in New York State may not realize that the New York trust laws regarding accounting income and principal have been completely revamped. The initial effective date of the revised laws was January 1, 2002 and is retroactive to all trusts that were in existence on that date and/or any date thereafter. Significant changes to these rules were made in August 2008 as well. The revamped New York State trust laws have three elements: the Uniform Principal and Income Act (UPAIA), the power to adjust (PTA) and the unitrust conversion. Any practitioner who is involved in trust drafting or trust litigation, or who prepares fiduciary income tax returns or trust accountings, must become aware of these revised trust rules in order to avoid potential malpractice and/or ethics issues"--Unedited summary from book cover.

Book Maintaining Your Client Trust Accounts with Tabs3

Download or read book Maintaining Your Client Trust Accounts with Tabs3 written by Michael Trittipo and published by . This book was released on 2019-03-21 with total page 52 pages. Available in PDF, EPUB and Kindle. Book excerpt: Every lawyer in Minnesota who holds any money of clients or third persons in connection with a representation must deposit the money in one or more identifiable trust accounts, and must maintain certain records about those trust accounts, and be able to produce them at any time. Minnesota Rules of Professional Conduct Rule 1.15 ("MRPC") details the obligations. Rule 1.15 is supplemented every year by an "Appendix 1," written by the Lawyers Professional Responsibility Board ("LPRB"). Those two documents tell you what records you must keep, but mostly do not tell you how. Nor, our new lawyer members every year tell us, do the law schools provide any training on how to keep trust accounts. This guide is meant to show how you can meet your obligations using the "Trust Accounting Software" ("TAS") module in Tabs3. Other ways exist, and other software programs. The Minnesota State Bar Association ("MSBA") has authored guides for several. One reason for adding a guide for Tabs3 lies in the fact that Tabs3 as a whole offers more than just trust accounting. It includes practice and case management, too. More and more lawyers are using such integrated programs. But the Tabs3 help materials for its trust accounting modules tend to be focused at a very low level, and do not give a good overview beginning at the "big picture" level, but with step-by-step instructions. This guide intends to fill that gap.
